Description/Agenda
The Hyde Park City Planning Commission will hold a Public Hearing to consider edits to the Hyde Park Gateway Development Agreement. The Hyde Park City Planning Commission will hold Public Hearings to consider edits to each of the following ordinances: 1. Land Use Table Regulation of property use in current zones. 2. 12.20 - Definitions Applicability - Definitions in Other Ordinances. The words and terms defined in this Chapter shall have the meanings indicated. Words used in the present tense include the future and words in the singular number include the plural and words in the plural include the singular. Words not included herein but defined elsewhere in the City ordinances shall be construed as termed therein. The word 'shall' is mandatory. 3. 12.50 - Planning Commission The Planning Commission shall consist of five (5) members. A City official or a member of the city staff will be an ex-officio member and will serve as secretary, having no vote. The five (5) voting members will be appointed by the mayor from the duly qualified electors of Hyde Park City with the consent of the City Council. The mayor, with the advice and consent of the City Council, shall select a chairperson and other officers as deemed necessary. The chairperson will serve one (1) year terms and may be reselected with no term limits. 4. 12.60 - Nonconforming Building and Uses The nonconforming use of a building or structure existing at the time the applicable zoning regulations become effective may be continued. A vacant nonconforming building or structure may be occupied by a use for which the building or structure was designed or intended if so, occupied within a period of one (1) year after the building or structure became nonconforming. A nonconforming use may be extended to include the entire floor area of the existing building in which it was conducted at the time use became nonconforming. Except by permit of the Board of Adjustment as provided in HPMC 12.50, the nonconforming use of a building or structure may not be changed except to a conforming use; but where such change is made to a conforming use, the use shall not thereafter be changed back to a nonconforming use. 5. 12.190 - Sign Ordinance The purpose of these sign regulations is to encourage the effective use of signs as a means of communication in the City of Hyde Park. 6. 12.100 - Zones The purpose of this Zoning Ordinance is that the City may be divided into the Zones in which land uses shall be limited as specified in this Ordinance. Classification will be determined based on location, topographic features, and other reasonable considerations to guide the orderly physical growth, neighborhood compatibility and overall stability of the city. 7. 12.110 - Agricultural Zone The purpose of the A-1 Zone is to designate areas, which are likely to undergo a more intensive urban development, to set up guidelines to continue agricultural pursuits, including the keeping of farm animals, and to direct orderly low-density residential development in a continuing rural environment. 8. 12.140 - Residential Multi Zone (R-5) The purpose of the R-2 Zone classification is to accommodate a need for moderate density residential district incorporating both single family and two-family dwelling units. 9. 12.190 - Open Space Zone (O-1) The Open Space Zone is specifically intended to encourage the preservation of a natural environment in an otherwise urban setting; to hold for future generations open space in which plants and animals can be protected and studied; to inhibit erection of unnecessary buildings on a flood plain, on areas of severe slope and areas of fault line and rock slides; to provide suitable areas for recreation and relaxation, and to alleviate stream pollution. 10. 12.210 - Appeal Authority The authority to hear requests for variances from the terms of the zoning ordinances and appeals from decisions applying the zoning ordinances shall be vested in the Hyde Park City Administrative Appeals Hearing Officer. 11. 12.230 - Airport Overlay The Airport Limitation Overlay Zones are intended to establish standards assuring the long range, safe and beneficial use of the Logan-Cache County Airport as it relates to the Hyde Park City Zoning Ordinances. 12. Public/institutional zone. A label that shows spots for schools, churches, etc. Existing churches are already in 'zones'. MASTER TRANSPORTATION PLAN Purpose: To assist with planning, development, and maintenance of the Hyde Park City transportation system and to anticipate future growth and project existing (2024) traffic patterns for the next 20 years out to the planning horizon year of 2044.
