Pursuant to House Bill 5002, 'Open and Public Meetings Act Amendments,' passed during the 2020 Fifth Special Session of the Utah Legislature and codified under Utah Code Ann. ยง 52-4-207(4), I, Alexa Wilson, hereby make the following written determination in my capacity as Chair of the Board of Trustees of the Ticaboo Utility Improvement District warranting the TUID Board to convene and conduct electronic meetings without a proper anchor location:

4. Review procedures for handling electronic participation by the public - Alexa Wilson
5. Public Comment -- TUID welcomes comments from the public. The Board sets aside 15 minutes at each Board meeting to hear from anyone wishing to speak. Each presenter is allowed one opportunity and has up to three (3) minutes for remarks. Any member of the public who desires to make a comment shall use the 'raise hand' feature during the Google Meet meeting. The public comment segment of the Board meeting is not the time for a question-and-answer discussion. TUID staff are available for dialogue outside of Board meetings.

11. Closed Meeting-Pursuant to Utah Code 52-4-205
(1) 'A closed meeting described under Section 52-4-204 may only be held for: (d) strategy sessions to discuss the purchase, exchange, or lease of real property or..(e) strategy sessions to discuss the sale or real property if public discussion would: (A) disclose the appraisal or estimated value of the property under consideration; or (B) prevent the public body from completing the transaction on the best possible terms; and (ii) the public body previously gave public notice that the property would be offered for sale; and (iii) the terms of the sale are publicly disclosed before the public body approved the sale'
(m) 'deliberations, not including any information gathering activities, of a public body acting in the capacity of: (i) an evaluation committee under Title 63G, Chapter 6a, Utah Procurement Code, during the process of evaluating responses to a solicitation, as defined in Section 63G-6a-103'
12. Motion and Roll Call Vote of the members to enter a Closed Meeting (District Clerk)
13. Review and discussion of bids for sale or rent of TUID mobile home-board vote to accept bid
14. Review and discussion of proposals for cost-of-service utility rate study, which was published on Sciquest and closed June 6th
15. Return to Regular Meeting from Closed Meeting. The Chair will announce if there are any action items following the Closed Meeting.
