PUBLIC HEARINGS:
1. PUBLIC HEARING TO RECEIVE PUBLIC COMMENT ON THE FISCAL YEAR 2027 BUDGET ENTERPRISE FUND TRANSFERS TO THE GENERAL FUND
BACKGROUND: Pursuant to Utah Code Annotated § 10-6-135.5, the City must hold a public hearing before adopting a final budget that includes transfers from an enterprise fund to another fund. The budget includes the transfer of resources from the Water Fund to the General Fund to recognize water used by the City's general operation. The amount of this particular transfer is $170,000. The budget also includes a similar transfer to reimburse the General Fund for its services provided to the Enterprise Funds. These particular budgeted transfer amounts are as follows: $140,035 from the Utility Admin Fund, $359,186 from the Water Fund, $382,075 from the Sewer Fund, $231,168 from the Storm Water Fund, and $45,858 from the Solid Waste Fund.
RECOMMENDATION: Receive public comment.
2. PUBLIC HEARING TO RECEIVE PUBLIC COMMENT ON ZTA 2026-0704, A CITY INITIATED ZONING TEXT AMENDMENT TO THE DOWNTOWN FORM BASED CODE REMOVING MULTI-FAMILY RESIDENTIAL AS A PERMITTED TYPE ON SECONDARY STREETS IN THE URBAN CORE COMMERCE (UC) ZONE
BACKGROUND: City Staff recently issued a request for proposal (RFP) from qualified consultants to work with the City, stakeholders, property owners, and the public to create a Civic & Town Center Vision and Implementation Plan focused on the area surrounding City Hall, including the adjacent Clearfield Town Square property. The goal of the Civic & Town Center planning effort is to create a long term vision emphasizing civic open space, recreation based placemaking, community programming, and implementation strategies that transform the area into a destination for residents and visitors while supporting surrounding commercial and civic development. During a recent work meeting on the Civic & Town Center Vision and Implementation Plan, the City Council directed staff to prepare a zoning text amendment pertaining to Multi Family Residential development on secondary streets with the Urban Core Commerce (UC) zone as part of preparations for creating the proposed plan.
RECOMMENDATION: Receive public comment.

The Open Comment Period provides an opportunity to address the Mayor and City Council regarding concerns or ideas on any topic relevant to city business. To be considerate of everyone at this meeting, public comment will be limited to three minutes per person. Participants are to state their names for the record. Comments, which cannot be made within these limits, should be submitted in writing to the City Recorder at nancy.dean@clearfieldcityut.gov.

4. PRESENTATION AND DISCUSSION ON THE PROPOSED PROPERTY TAX IMPACT SCHEDULE (PTIS)
BACKGROUND: Utah Code § 59-2-919(4) requires the City to present a Property Tax Impact Statement (PTIS) identifying the uses of additional property tax revenue. The PTIS for the Fiscal Year 2027 property tax increase of $233,106 (6.59%) includes the FY 2026 increase that was subsequently rejected by the Utah State Tax Commission due to a statutory compliance issue. The additional revenue is needed to maintain existing service levels due to slowing sales tax growth and reduced development activity.
5. CONSIDER APPROVAL OF RESOLUTION 2026R-20 SETTING THE CITY'S 2026 PROPERTY TAX RATE AT 0.001253, A RATE ABOVE THE DAVIS COUNTY CERTIFIED TAX RATE
BACKGROUND: Davis County finalized Clearfield's 2026 total property valuation and certified tax rate. Because the City's taxable property value increased by 8.1%, state law requires the certified tax rate to be adjusted downward so that property tax revenue from property taxed in both years remains approximately the same as the prior year, excluding revenue from new growth and other statutory adjustments. The City is proposing a property tax rate of 0.001253, which is above the City's certified tax rate and is expected to generate approximately 6.59% more property tax revenue than would be generated by the certified tax rate. The proposed property tax rate increase provides funding for key needs identified during the budget process to address the City's evolving service demands. Throughout the budget process and during multiple public presentations, the City identified five budget priorities totaling the amount of the proposed increase and communicated that these items would need to be eliminated if the proposed property tax rate increase was not approved. These items are summarized in the attached Property Tax Impact Schedule. The City Council held a Truth in Taxation public hearing to receive comment on the proposed tax rate on Tuesday, August 14, 2026 at 7:00 p.m.
RECOMMENDATION: Approve Resolution 2026R-20 setting the City's 2026 property tax rate at 0.001253 and authorize the mayor's signature to any necessary documents.
6. CONSIDER APPROVAL OF ORDINANCE 2026-11 ADOPTING THE FISCAL YEAR 2027 FINAL BUDGET
BACKGROUND: The City presented its Fiscal Year 2027 Tentative Budget on May 12, 2026 and announced the proposed budget as presented contemplated a property tax increase. A public hearing on the Tentative Budget was held on June 9-2026 to receive public comment on the proposed budget and to set a Truth in Taxation public hearing for August 4, 2026 to receive public comment on the proposed tax increase. On June 23, 2026, the City adopted it Property Tax Impact Schedule and Fiscal Year 2027 Interim Budget. The Interim Budget provided a mechanism for the City to continue operating until public comment was received and a final property tax rate was set.
RECOMMENDATION: Approve Ordinance 2026-11 adopting the Fiscal Year 2027 Final Budget and authorize the mayor's signature to any necessary documents.
7. CONSIDER APPROVAL OF ORDINANCE 2026-12 AMENDING THE DOWNTOWN FORM BASED CODE TO REMOVE MULTI FAMILY RESIDENTIAL AS A PERMITTED BUILDING TYPE ON SECONDARY STREETS WITHIN THE URBAN CORE COMMERCE (UC) ZONE
RECOMMENDATION: Approve Ordinance 2026-12 amending the Downtown Form Based Code to remove Multi Family Residential as a permitted building type on secondary streets within the Urban Core Commerce (UC) zone and authorize the mayor's signature to any necessary document.
8. CONSIDER APPROVAL OF RESOLUTION 2026R-21 APPROVING AMENDMENTS TO THE CITY COUNCIL RULES OF ORDER
BACKGROUND: Utah Code Annotated § 10-3-606 requires a municipal body to adopt Rules of Order to govern parliamentary order, ethical behavior, and civil discourse. The Clearfield City Council adopted its Rules of Order on August 27, 2019. The City has since identified some proposed amendments that need to be made to the document. The City Council discussed the amendments at its meeting on July 28, 2026
RECOMMENDATION: Approve Resolution 2026R-21 approving amendments to the City Council Rules of Orders and Procedures and authorize the mayor's signature to any necessary documents.
9. CONSIDER APPROVAL OF RESOLUTION 2026R-22 APPROVING AMENDMENTS TO THE PLANNING COMMISSION BYLAWS
BACKGROUND: The Planning Commission is required to have rules governing its procedures during a public meeting in accordance with Utah Code Annotated § 10-20-301. Recently the City Council changed Planning Commission terms to three years. This change needed to be added to the Planning Commission Bylaws. Staff also identified other proposed amendments needed in the bylaws. The Council discussed the amendments at its meeting on July 28, 2026.
RECOMMENDATION: Approve Resolution 2026R-22 approving amendments to the Planning Commission Bylaws and authorize the mayor's signature to any necessary documents.
