NOTICE OF INTERLOCAL AGREEMENT BETWEEN WEBER FIRE DISTRICT AND THE COMMUNITY REINVESTMENT AGENCY OF WEBER COUNTY REGARDING FUNDING FOR THE NORDIC VILLAGE COMMUNITY REINVESTMENT PROJECT AREA
Pursuant to Utah Code Annotated §11-13-219 and Utah Code Annotated §17C-5-205, notice is given that Weber Fire District has entered into an Interlocal Cooperation Agreement ('Agreement') with the Community Reinvestment Agency of Weber County ('Agency').
The Agreement sets forth the terms and conditions of Weber Fire District's participation in the Nordic Village Project Area ('Project Area') and allows for a percentage of Weber Fire District's tax increment which will be generated in the Project Area to be paid to the Agency to provide funds to carry out the Nordic Village Project Area Plan and Budget ('Plan' and 'Budget').
Weber Fire District agreed to allow the Agency to collect tax increment for a period of fifteen (15) years in accordance with the Plan and Budget, noting in the Agreement that failure of the Agency to adopt the Plan and Budget as attached in the Agreement or failure of the Weber County Commission to adopt the Plan by ordinance will render the Agreement void.
Copies of the Agreement, and of Resolution CRA04-2024 adopted by the Agency and Resolution 18-2024 adopted by the Board of Weber Fire District Trustees each approving execution of the Agreement are available for review at the Weber Fire District's Administrative Office during regular business hours, Monday through Thursday, 7:30 a.m. through 6:00 p.m., for 30 days after the publication of this notice. The address is 2023 W. 1300 N., Farr West, Utah.
For a period of 30 days following the publication of this notice ('30-Day Period'), any person in interest may contest the Agreement or the procedure used to adopt it if the Agreement or the procedures fail to comply with any applicable statutory requirement. After the 30-Day Period, a person may not contest: (i) the Agreement; (ii) a distribution of tax increment to the Agency under the Agreement; or (iii) the Agency's use of Project Area funds under the Agreement.
