The zoning map has been updated to reflect the recent zone change at 455 W. Hwy 43.
Shane Philbrick is approaching the board to get a building permit to build a garage on the front of his lot at 35 W. 3rd N. Shane applied for a valence in August of 2023. A planning and zoning meeting was held on the 18th of September in 2023. He was denied his permit due to the garage being proposed to be in the front of the lot and in front of the house. A board of adjustments meeting was held the following day, September 29th 2023 and a variance was approved. No following meetings were held and the Board of Adjustments was dissolved. The minutes for the BOA meeting held on the 19th are only a draft and were never approved. No payment was made, and no further paperwork or records were created. What does the board want to do moving forward? Some options are as follows: amend the ordinance (listed in next point), have Mr. Philbrick re-apply for a variance, approved with breezeway, deny or table.
One option to resolving the above issue is to amend the ordinance in Article 5, Section 503, Number 7 which states: No unattached garage, accessory building or outbuilding may be built on the front of the lot.
