BACKGROUND: Pursuant to Utah Code Ann. § 78A-7-103, the Clearfield Municipal Justice Court is required to be recertified at the end of each four-year term. The current term of the Clearfield Municipal Justice Court expires on January 31, 2024. In order to be recertified, the City must submit to the Administrative Office of the Courts: an affidavit submitted by justice court judge, an opinion letter from the City attorney, and a resolution adopted by the City Council. Each of the above items was provided to the Council in the agenda packet and are required to be submitted to the Administrative Office of the Court no later than December 15, 2023.
RECOMMENDATION: Approval Resolution 2023R-11 requesting recertification of the Clearfield Municipal Justice Court and authorize the Mayor's signature to any necessary documents.
4. CONSIDER APPROVAL OF RESOLUTION 2023-12 APPROVING THE INTERLOCAL AGREEMENT BY AND BETWEEN CLINTON CITY, CLEARFIELD CITY, SUNSET CITY, AND WEBER BASIN WATER CONSERVANCY DISTRICT (WBWCD) FOR THE 800 NORTH ROADWAY AND UTILITY IMPROVEMENTS
BACKGROUND: The 800 North road from 450 West to 1000 West needs to be reconstructed in several areas. Clearfield City's staff started looking at options for the reconstruction of this section of road a few years ago. It was determined to be a great project to partner with Clinton City and Sunset City because of their portions of ownership in the road. The cities felt the project would be a good candidate to apply for Davis County's Third Quarter Transportation Funding. Clinton City is taking the lead on the project and submitted the application to the County. The project has been awarded $1.516 million from the County with a local match of 20% totaling $379,000. The local match is to be funded per the interlocal agreements terms. The agreement defines the roles and responsibilities of the parties and specifically addresses the obligations of parties in relation to preparing, bidding awarding, and managing the project. The project team feels like combining the needs of the parties into one single project is in the best interest of the parties. The project team comprises JUB Engineers, Inc., as the engineering firm, Clinton City, Clearfield City, Sunset City and WBWCD.
RECOMMENDATION: Approve Resolution 2023-12 approving the Interlocal Agreement by and between Clinton City, Clearfield City, Sunset City, and Weber Basin Water Conservancy District for the 800 North roadway and utility improvements and authorize the Mayor's signature to any necessary documents.
