Those present at the City Council meeting were Mayor Kim Soper, City Manager Lori Talbot, City Recorder Tyrissa Howell, City Attorney Barry Huntington, Council Members Paul Dastrup, Mark Boshell, Mike Sarles and Tracy Wright. Council Member David Dodds was in attendance by Zoom.
Others present were Kevin Smedley, Maxi Miller, Nicholas Dax, Kelly Holman and Chuck Hughes.
The meeting was called to order at 5:30 pm.
OPENING CEREMONY
City Attorney Barry Huntington conducted the opening ceremony.
ADOPTION OF THE AGENDA
Mike Sarles moved, seconded by Mark Boshell to adopt the agenda. The motion passed with all in favor.
APPROVAL OF THE MINUTES
Tracy Wright moved, seconded by Mike Sarles to approve the minutes as corrected. The motion passed with all in favor.
TENTATIVE 2023-2024 BUDGET
Paul Dastrup moved, seconded by Tracy Wright to approve the 2023-2024 tentative budget with the addition of $15,000 for the Social Hall and increasing the judge's wages to meet state requirements. The motion passed with all in favor.
GENERAL PLAN - KEVIN SMEDLEY 5 COUNTY AOG
The City Council went over elements that could be added to the general plan. A committee will be created to draft a public survey.
PROPERTY LINE ADJUSTMENT AT SEWER LAGOON
Roxanna Simpkins sold her piece of property at the sewer lagoons to Tom Hatch.
Paul Dastrup moved, seconded by Mark Boshell to purchase property from Tom Hatch for $4000. The motion passed with all in favor.
LANDFILL
Following a landfill inspection, Chuck Hughes was invited to speak to the City Council. During the meeting, concerns were raised about the lack of cover over the pit, the large size of the brush and the metal piles. Chuck Hughes addressed these concerns by stating that he plans to burn the brush pile when there is minimal wind. He stated the dozer is out of order. He has been utilizing his own personal equipment, but it isn't suitable. He has purchased a trailer to transport the metal to be recycled. There was a discussion on the landfill permit requirements and the current contract hours. The City Manager, Lori Talbot will contact the State about some of the permit requirements.
SOFTBALL FIELDS SURVEY
Mark Boshell moved, seconded by Paul Dastrup to take $5700 out of surplus to survey the softball fields. The motion passed with all in favor.
TRIPLE C CONCESSIONS
Paul Dastrup moved, seconded by Mike Sarles to put the PHS Wrestling Invitational, the Panguitch High School Rodeo, Senior Pro Finals, the Little Britches Rodeo and the Invitation Rodeo concessions out to bid. The remaining event concessions would go to volunteers. The motion passed with all in favor.
CITY CAR POLICY
A draft policy for the city car will be prepared for review by the City Council.
ELEVATE FITNESS LLC - CONDITIONAL USE PERMIT
Maxi Miller and Nicholas Dax would like to construct a fitness center measuring 70 by 100 feet in an agricultural zone. They have collected signatures and submitted them to the Planning and Zoning Committee. Planning and Zoning recommend the approval of a conditional use permit. David Dodds noted that 175 West is not large enough to accommodate the amount of traffic increases it will see with the businesses going in the area.
Tracy Wright moved, seconded by Mark Boshell to approve Elevate Fitness LLC's conditional use permit. The motion passed with all in favor.
DEPARTMENT REPORTS/CALANDER
Right of way - City Attorney Barry Huntington will be drafting a right of way ordinance.
Key leader meeting - There is a key leader meeting Thursday, May 11th at noon at the Smokehouse.
Aspen Valley Subdivision - There have been concerns raised regarding the adequacy of the size of the drainage pipe being used. Road chips are being stored at the fair building in preparation for the subdivision roads.
Lake Road - The City Council and City employees will be picking up trash along Highway 143 going up the lake road Friday, May 12th at 7 am.
Elections - Municipal Elections declaration period will be June 1-7, 2023.
Springs - The spring water has been removed from the system as it turned green. All water tests have shown the water to be safe for use.
Industrial Park - Gordon Whiting has offered to donate a plot of land, located near the upcoming addition to the industrial park, for the purpose of establishing a dog pound in the future.
Flowerpots - Flowerpots donations are $80 a pot.
Scholarships - The Mayor requested the City Council to stay after the meeting to review scholarship applications.
