REQUEST FOR RELEASE OF FUNDS
On or about November 8, 2026 the State of Utah, Governor's Office of Economic Development, Division of Housing & Community Development (DHCD), will submit a request to the U.S. Department of Housing and Urban Development for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974, Public Law 93-383, as amended in 42
U.S.C. 5301 et seq., to undertake the project known as Riverside North Garland Waterline Improvements, located north of Plymouth, Utah 84330.
The Riverside North Garland Water Company proposes improvements to its existing culinary water system located east and west of Interstate 15 and north of Plymouth, Utah. The proposed project would be funded in part through the Community Development Block Grant program and is intended to improve system capacity, reliability, and delivery of potable water within the existing service area. The Area of Potential Effects (APE) consists of a linear corridor encompassing approximately 4,200 linear feet of pipeline improvements, extending from an existing well site west of Interstate 15 to the existing reservoir complex east of Interstate 15 and distribution network along 6000 West. The APE is limited to previously developed and maintained utility corridors, including roadway rights-of-way and an existing dirt access road. Although CDBG funds will only be used for pipeline improvements and installations, the general undertaking includes the following project components: Phase 1 - Welling Well Rehabilitation (Existing Facility): Rehabilitation of an existing well within its current footprint to meet Division of Drinking Water (DDW) requirements. No expansion beyond the previously disturbed well site is proposed. Phase 2 - New Well Connection (Approximately 300 Linear Feet): Construction of approximately 300 linear feet of new 6-inch diameter pipeline to connect the existing well to the existing water transmission system.
Installation will occur within an existing disturbed access road. Phase 3 - Distribution Line Upgrade (Approximately 3,900 Linear Feet): Replacement and upsizing of approximately 3,900 linear feet of existing 6-inch pipeline along 6000 West with a new 10-inch diameter pipeline to improve system capacity and conveyance. Work will occur within existing roadway rights-of-way and utility corridors. Existing pipeline infrastructure within the APE will remain in place where it is not specifically improved but is included in this Environmental Assessment (EA) to evaluate the full extent of potential environmental effects associated with the undertaking. The project does not involve expansion of the service area or construction in previously undisturbed locations. All ground disturbance will be confined to existing rights-of-way, access roads, and previously disturbed areas.
This project is requesting $195,000.00 in CDBG funding as part of a projected total cost of:
$1,019,910.00
FINDING OF NO SIGNIFICANT IMPACT
DHCD has determined that the project will have no significant environmental impact. Therefore, an Environmental Impact Statement under the National Environmental Protection Policy Act of 1969 (NEPA) is not required. Additional project information is contained within the Environmental Review Record (ERR) on file with the Utah DHCD office. Email brandoncc@utah.gov for electronic copies of the ERR.
PUBLIC COMMENTS
Any individual, group, or agency may email comments to DHCD's Environmental Review Specialist at brandoncc@utah.gov. ENVIRONMENTAL CERTIFICATION
DHCD certifies to HUD that Tricia Davis Winter, in her official capacity as DHCD Managing Director, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows DHCD to use Program funds.
OBJECTIONS TO HUD RELEASE OF FUNDS
HUD will accept objections to its release of funds and DHCD's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of DHCD; (b) DHCD has omitted a step or failed to make a decision or finding required by U.S. Department of Housing and Urban Development regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs, or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency, acting pursuant to 40 CFR part 1504, has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Noemi Ghirghi, CPD Region VIII Director, at CPDRROFDEN@hud.gov. Potential objectors should contact CPDRROFDEN@hud.gov to verify the actual last day of the objection period.
