The Open Comment Period provides an opportunity to address the Mayor and City Council regarding concerns or ideas on any topic relevant to city business. To be considerate of everyone at this meeting, public comment will be limited to three minutes per person. Participants are to state their names for the record. Comments, which cannot be made within these limits, should be submitted in writing to the City Recorder at nancy.dean@clearfieldcityut.gov.
The Mayor and City Council encourage civil discourse for everyone who participates in the meeting.
3. CONSIDER APPROVAL OF ORDINANCE 2026-13 ESTABLISHING A TEMPORARY LAND USE REGULATION REGARDING DATA CENTER USES WHILE THE CITY EVALUATES APPROPRIATE LAND USE CLASSIFICATIONS AND DEVELOPMENT STANDARDS
BACKGROUND: Data centers are facilities primarily used to house and operate computer servers and related data-processing infrastructure. Clearfield City Code does not currently define or specifically regulate data centers, which may have unique impacts related to electrical and water demand, cooling systems, wastewater, backup power, noise, fire protection, emergency response, and utility infrastructure. The City Council is considering a temporary land use regulation to allow time to evaluate these uses and determine whether permanent land use standards should be adopted.
RECOMMENDATION: Approve Ordinance 2026-13 establishing a temporary land use regulation regarding data center uses and authorize the mayor's signature to any necessary documents.
4. CONSIDER APPROVAL OF RESOLUTION 2026R-23 AUTHORIZING THE EXECUTION OF A FRANCHISE AGREEMENT WITH FORGED FIBER 37, LLC
BACKGROUND: Forged Fiber is an indirect, wholly owned subsidiary of AT&T that provides fiber internet services. The company is currently acquiring some or all of Lumen's (CenturyLink) existing fiber infrastructure within Clearfield and plans to expand the fiber network with additional installations. As part of these activities, Forged Fiber 37, LLC has requested a nonexclusive franchise agreement with Clearfield City to construct, operate, and maintain its telecommunications network within the City's public rights-of-way.
RECOMMENDATION: Approve Resolution 2026R-23 authorizing the execution of a franchise agreement with Forged Fiber 37, LLC, and authorize the mayor's signature to any necessary documents.
