ORDINANCE NO. 2026-027__ AN ORDINANCE ADOPTING AN UPDATED STORM WATER MANAGEMENT PLAN (SWMP) UPDATING AND INCLUDING NEW STANDARD OPERATING PROCEDURES; UPDATING CERTAIN APPENDICES; AND OTHER NECESSARY CHANGES AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Pleasant Grove City owns and operates a storm drain system to provide a level of protection to its citizens from storm water flows; and WHEREAS, City prepared an initial Storm Water Management Plan (SWMP) as required by State and Federal Law in order to obtain permission to discharge storm water into the Waters of the State; and WHEREAS, In August 2010, the Utah State Division of Water Quality issued an updated SWMP permit which requires the City to updates its SWMP annually in order to continue to discharge to Waters of the State; and WHEREAS, City has subsequently updated its SWMP in 2016 and in 2020; and early 2026; and WHEREAS, This latest updated SWMP represents the latest updates and outlines the City's commitment to protect water quality; and WHEREAS, Pleasant Grove City has prepared this latest SWMP to comply with the Small MS4 General UPDES Permit No. UTR090000 and obtain authority to discharge to Waters of the State; and WHEREAS, an updated permit from the State was issued in March of 2025 and a Notice of Intent has been filed with the Division of Water Quality as required by state law declaring the City's intent to update its SWMP; and WHEREAS, the proposed updated SWMP creates new SOPs for certain functions; updates certain SOPs to match current processes; updates the Organizational Chart; Updates the Preconstruction Onsite Meeting Form, Updates Appendix B; and adds Sections 4.2.5.4 and 4.2.6.4 and makes various other updates and corrections to the previous Plan; and WHEREAS, the city desires to adopt the Updated Storm Water Management Plan; and WHEREAS, a duly noticed public hearing was held on September 1, 2026 for the City Council to receive public input on the updated Storm Water Management Plan; and NOW, THEREFORE, BE IT ORDAINED by the Pleasant Grove City Council as follows: SECTION 1 the Updated Storm Water Management Plan (SWMP) as shown attached hereto as Exhibit 'A' is now adopted. SECTION 2. SEVERABILITY. The sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable. If any such section, paragraph, sentence, clause, or phrase shall be declared invalid or unconstitutional by the valid judgment or decree of a Court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any of the remaining sections, paragraphs, sentences, clauses or phases of this Ordinance. SECTION 3. EFFECTIVE DATE. This ordinance shall take effect immediately upon its passage and posting as provided by law. SECTION 4. APPROVED AND ADOPTED by the City Council of Pleasant Grove City, Utah County, Utah, this 1st day of September, 2026.
