PANGUITCH CITY COUNCIL MINUTES PANGUITCH CITY OFFICE CONFERENCE ROOM, 25 S 200 E PANGUITCH, UTAH 84759 AUGUST 12, 2025, 5:30 PM Those present at the City Council meeting were Mayor Kim Soper, City Manager Mat Houston, City Recorder Tyrissa Howell, City Attorney Barry Huntington, and Council Members Paul Dastrup, Tracy Wright, Cindy Stewart, Mike Sarles, and David Dodds. Others present were Harshad Desai, Steve Garrett, Ed Ryan, and Beth Ryan. The meeting was called to order at 5:30 p.m. OPENING CEREMONY Council Member Paul Dastrup conducted the opening ceremony. ADOPTION OF THE AGENDA Cindy Stewart moved, seconded by Mike Sarles, to adopt the agenda. The motion passed with all in favor. APPROVAL OF THE MINUTES Paul Dastrup moved, seconded by Tracy Wright, to approve the minutes as corrected. The motion passed with all in favor. SECONDARY WATER - HARSHAD DESAI Harshad Desai stated that Panguitch City owns 393.24 irrigation water shares. He believes these shares are a public asset. Mr. Desai mentioned that currently, there are 1279 parcels in Panguitch City. He feels all 1279 parcels should have access to secondary water. Harshad owns parcel 236 and parcel 455, which do not have secondary water, and he requested that his parcels be provided with secondary water. Mr. Desai stated that West Panguitch Irrigation Company has 362 water shares available, and he suggests that Panguitch City buy 250-300 shares for residents who lack secondary water. Harshad Desai pointed out that West Panguitch Irrigation is a private entity, and Panguitch City should not be supporting a private company. Mr. Desai also said that the Panguitch City Council should have individual opinions and should not conduct closed-door meetings. Mayor Kim Soper stated that commercial properties did not receive secondary water. Paul Dastrup explained that when the secondary system was built, property owners had to transfer or buy secondary water shares to get connected. Barry Huntington warned the City Council to be careful in how they respond to Mr. Desai, noting that Mr. Desai likes to seek lawsuits. Mayor Soper clarified that West Panguitch Irrigation is a water district, not a private company, and Panguitch City is a shareholder. City Manager Mat Houston informed the City Council that, due to record retention laws, the city is not required to provide more information or create new records for Mr. Desai regarding Panguitch City water shares. PANGUITCH CITY FIRE CHIEF Nick Frandsen was hired to be the Panguitch City Fire Chief and started on July 1, 2025. ORDINANCE 2025-3 SHORT-TERM RENTAL AMENDMENTS The City Council would like the wording to be changed to specify that privacy fencing at the maximum height allowed according to Panguitch City's Fencing ordinance on the sides and rear of the short-term rental is required. David Dodds moved, seconded by Tracy Wright, to approve the Short-Term Rental amendments with the discussed changes. The motion passed with all in favor. ORDINANCE 2025-4 ACCESSORY DWELLING UNITS Tabled for corrections to be made to the document. SECONDARY WATER - BRUCE FULLMER Bruce Fullmer was the City Manager when the secondary system was installed. Mr. Fullmer stated that residents were required to either turn in a third of a water share to Panguitch City or pay for a third of a water share to have a secondary connection at their property. Commercial properties were exempt from connecting to the secondary water system. Residents were informed that if they did not connect now, they would not be able to do so later. Mayor Soper informed Mr. Desai that he would not be able to connect his commercial parcels to the secondary water system. BUSINESS LICENSE - DUSK TO DAWN VACATION RENTAL MANAGEMENT Cindy Stewart moved, seconded by Mike Sarles, to approve the business license for Dusk 2 Dawn Vacation Rental Management. The motion passed with all in favor. BUSINESS LICENSE - APEX HEALTH CHIROPRACTIC AND REHAB AT 415 E CENTER Tracy Wright moved, seconded by David Dodds, to approve the business license for Apex Health Chiropractic and Rehab at 415 E Center. The motion passed with all in favor. PLANNING AND ZONING MEMBERS Mike Sarles moved, seconded by David Dodds, to accept Ford Stewart as a Planning and Zoning member. Cindy Stewart abstained. The motion passed. Tracy Wright moved, seconded by David Dodds, to accept Jaynie Connor as a Planning and Zoning member. The motion passed with all in favor. DEPARTMENT REPORTS Semi Traffic - Semi trucks parking at the old truck stop are using 100 N frequently. The trucks are driving fast and not stopping for pedestrians. Traffic - The City Council would like to slow traffic on East Center Street now that school is back in session. Because it is a highway, UDOT would have to approve any traffic signs or lights. National Day of Service - The National Day of Service had 70 youth and leaders come to paint the wooden boards for the picnic tables. There were 40 volunteers who helped put the tables together for a total of 470 volunteer hours. Landfill - Complaints have been received of landfill workers yelling at residents dumping at the landfill. The City Council would like to perform a landfill inspection. Council Member David Dodds has been working with the BLM to expand the landfill. The application to expand the landfill was put in five years ago, and the BLM just notified Mr. Dodds that the fee for the application has not been paid. Crosswalks - Council Member Tracy Wright inquired about the possibility of installing a crosswalk on the north end of Main Street, near Family Dollar, for pedestrian safety. Main Street is a Highway, and UDOT typically avoids crosswalks on highways. Secondary Water - The last day for secondary water will be August 24th. Accident - A decorative light pole and a Quilt Walk brick pillar were hit by a truck early this morning. The driver did not have insurance. Marilyn Bulkley Park - Council Member Paul Dastrup has mowed and weed-eaten at the Marilyn Bulkley Memorial Park. He requested that next summer, he would like to see it done every two weeks by the city workers. Roads - Council Member David Dodds has found a piece of equipment for rent that could be useful in saving the edges of Panguitch City roads. ATV Rally - The Bryce ATV Rally starts tomorrow. Social Hall - The security system and locks for the Social Hall have been completed. Key fobs will be sold for $30 a year. Roofing - Strout Roofing will be coming to replace the roof on the clubhouse at the ball field and check the roof on the social hall.
