R392-302 Cold Plunge Tubs Can you please add approval of this draft language for R392-302 addressing cold plunge tubs to our Governance agenda for November 6th? It has been approved by the Environmental Health Exec group and needs to be ratified by the committee.

R392-302-2. Applicability.
(1) Unless exempted in Subsection R392-302-2(2), this rule applies to any person who owns or operates a facility or public pool.
(2) This rule does not apply to:
(d) a body of water that is drained, cleaned, sanitized, and refilled after each individual use;
(e) a cold plunge tub.
(10) 'Cold plunge tub' means a tub or tank containing chilled water that:
(a) is maintained at a temperature equal to or lower than 70 degrees Fahrenheit;
(b) is designed for solitary use;
(c) has a water depth and design that allows the user to maintain their head above the water while in a seated position; and
(d) does not exceed 200 gallons.
