AGENDA ITEMS
1) John Mackey - Utah Department of Environmental Quality
- John Mackey with the Utah Department of Environmental Quality will be here to answer questions for the MGSID Board regarding our growth issues.
- Will Serve limitations and over committing: Our system is rated for 1,800 ERUs and we have 1,409 committed. That leaves 391 left to issue and we could run out of those in the next year or so.
- There are 1,116 ERUs actually connected so we have 684 more actual connections to make, which could take six or more years.
- Does MGSID become a regional processing center for all of the surrounding communities?
- Annexations, plant sizing, infrastructure sizing and finance?
- What would the state like to see for this region and how can they help?
- Would the have the right to use secondary water from the current or new plant?
- The Board has been asking questions on recalculating impact fees, plant sizing, timing, bonding, etc. Time to open this discussion with the appropriate representatives at the state level.
2) Bylaws work
- The Board requested a discussion/decision item on the Agenda regarding Bylaws work. Items #1 & #2 were reviewed and approved in the May meeting, and at the July meeting, all Board Members were asked to review the suggested document at home and come to the August meeting prepared to make some final changes and approvals.
3) Ordinance Change for Fee Schedules
- These are the proposed changes to the MGSID Sanitary Sewer Ordinance: Addition of items 3.05, 3.06 & 3.07 to the existing Ordinance. No changes to any other items or wording of the existing Ordinance last approved January 1, 2016. They have been reviewed and updated with suggestions by our attorney, Jon Call.
- Does the Board approve the following Ordinance Changes/Additions?
- Article II - General; Part Three - District Fees
- 3.05 The Board has set a Credit Card Convenience Fee at $3.00 per charge processed. This is to offset the cost of bank discount charged to the District for each transaction, along with monthly service fees and equipment expenses.
- 3.06 The Board sets a late fee and interest penalty policy as follows:
A. There are no 'late fees' charged for payments received after the due date.
B. Outstanding balances that are 60 days or more in arrears will have an interest penalty of 18% per annum added each month at statement time.
C. A notice of delinquency and collection letter will be issued to any account over $200 in arrears. This letter will note that outstanding balances over $250 will be sent to the Morgan County for attachment to the property taxes of the address in question.
D. When accounts are six months in arrears and/or have an outstanding balance of $250 or greater, as of mid-September, they will be turned over to the Morgan County Treasurer to be included as a lien against the premises and included in their property taxes that are sent out in November, as per section 17-A-2-310(3) of the Utah Code Annotated. After the deadline and once a balance has been sent to Morgan County for attachment, it cannot be recalled and will become part of the property tax bill for said property in November. After the county collects the taxes and forwards them to MGSID, the amount collected will be credited to that properties account. The owner of the residence is responsible to make all ongoing monthly sewer charges above the amount sent for attachment.
- 3.07 The Board has set a policy stating that all properties connected to the MGSID sewer system shall have the monthly sewer service billed directly to the owner of record for each property and that the owner shall be responsible for the payment of all fees relating to that property. If an owner of a property chooses to rent out the residence to another party, the monthly billing and fees shall remain in the owner's name and mailed to the address of record for the property owner. MGSID shall not be responsible for changing the billing name or contact information to that of a Tenant. It is the responsibility of the property owners to collect the sewer service fees from their tenants and ensure all fees are current. It is also the responsibility of the property owners to keep the MGSID office current with all of the owner's contact information and mailing address if it is different than the physical property address. A $60.00 fee will be assessed for processing the paperwork associated with any name and address change that is not the property owner's on an account. All individuals shall be required to present proof of ownership prior to establishing an account in their name.
4) Commercial Will-Serve / Developer's Agreement
- The Gardners have signed and returned the 'Will Serve/Developer's Agreement' for their first commercial building as presented.
5) Board Plaque
- The Board requested Janet to research the cost and type of plaque available to list all prior Board Members.
6) Office copier replacement
- The copier in the office is almost ten years old (Feb 2009) and has been jamming, breaking down and requiring service calls on a regular basis with duplex (double sided copies) being the main culprit. Due to its age, software updates and support are non- existent and replacement parts are hard to find.
- The Les Olson Company, who supplied and services this copier, has provided quotes for new replacement options as follows:
- Black and White; Sharp MX-M3050; Purchase = $3,545*; Lease = $82.24 per month for 60 months (=$4,934); Service Rate = .0075 ** per page.
- Color; Sharp MX-3050V; Purchase = $4,445*; Lease = $103.12 per month for 60 months (=$6,187); Service Rate = .0085 ** per black and white page & .053 ** per color page
* Includes trade in discount for old copier of $275
** Per page cost for the Premier Service Contract that includes all supplies such as toner, developer, heat rollers and drums, plus all parts, labor, service and travel for any calls.
- Does the Board want to replace the old copier, and if so, with which machine?
7) Monthly Auditor's Report
- The monthly audit report will be given by Board Member Larry Nance.
8) New Business
- Recommended Agenda Items for August 2018.
- Questions for Staff?
9) Manager's Report
- The Manager's report will be presented at the Board Meeting and then attached to the approved Minutes for recordation.
