He requests the zoning of these 20.58 acres be changed from A-1, Agricultural to RE-20, Residential. This is the third time he has requested this of the city. The first two times, 2005 and 2008, were denied by City Council with split votes. Note: Melinda inadvertently failed to publish this as a Public Hearing so no recommendation will be made to city council this night. WEST PARK COMMERCIAL SUBDIVISION - Administrative Discuss the preliminary plat of the West Park Commercial Subdivision located at 250 West 3700 North. The application was submitted by Mark Lynne and includes plans for two lots on approximately 7.2 acres. See minutes from LUA 8-17-2016, Ordinance sections 12.180, sub-sections 040 and 060 and 13.30, sub-sections 010, 030 and 040. Note: Again, Melinda inadvertently failed to publish this as a Public Hearing so no recommendation will be made to city council this night. REPLACE SPECIAL WITH CONDITIONAL USE PERMITS - Legislative In order to better conform to widely accepted terms, replace Special Use Permits with Conditional Use Permits. Discuss desired changes and possibly forward to City Council for approval. REAR SETBACK DISCUSSION - Legislative Darrin Hancey, Building Inspector, says our ordinance limits decks to 60 square feet and 2 1/2 feet into the rear setback. To him, there is no distinction between the home and the deck; a deck is structurally part of the house. See 12.110.050 C. for A-1, 12.120.050 C.4. for RE-20, and 12.130.060 C.4. for R-1. ACCESSORY APARTMENTS, RENTAL PROPERTIES, AND VACATION RENTAL HOMES DISCUSSION - Legislative Someone considering purchasing a Hyde Park home inquired about using it as a vacation rental home, ie. Air B&B, VRBO. The home has a separate bedroom and bathroom she would keep personally to live in 4-5 months each year and some holidays. Does our ordinance allow this? Do we want to regulate vacation rentals? What have other cities done? OPEN SPACE AND BONUS DENSITY - Legislative Continue discussion to change the city code to remove the open space option from builders, allowing only bonus density as an option to standard requirements.
