Description/Agenda: | ¬SANTA CLARA CITY COUNCIL SPECIAL MEETING WEDNESDAY, JUNE 30, 2016 MINUTES THE CITY COUNCIL FOR THE CITY OF SANTA CLARA, WASHINGTON COUNTY, UTAH, met for a Special Meeting on Wednesday, June 30, 2016, at 5:00 p.m. in the City Council Chambers of the City Hall at 2603 Santa Clara Drive, Santa Clara, Utah. Notice of the time, place and agenda of the meeting was provided to the Spectrum and to each member of the governing body by emailing a copy of the Notice and Agenda to the Spectrum and also, along with any packet information, to the mayor and each council member, at least two days before the meeting. Present: Mayor Pro Tem Tode (Mary Jo) Hafen Council Members: Herb Basso; Jerry Amundsen; Ken Sizemore; Tode (Mary Jo) Hafen; Jarett Waite Assistant City Manager: Brock Jacobsen Deputy Recorder: Lisa Bundy 1. Call to Order: Mayor Pro Tem Hafen called the meeting to order at 5:04 p.m. 2. Opening Ceremony: - Pledge of Allegiance: Mary Jo Hafen - Opening Comments: Mary Jo Hafen 3. Working Agenda: A. Public Hearing (s): 1. Public Hearing to receive public input and to discuss or take action on the proposed Amendment of the 2015-2016 Operating and Capital Budget. - 5: 04 pm Public Hearing Opened. - Brock Jacobsen, Assistant City Manager, said the purpose of the Public Hearing is for the Amendment for the Fiscal Year 2015-2016 Operating and Capital Budget. He said that this is due to making sure the City is in compliance with State law that the City's expenditures are not more than the City's revenue in the General Fund and also in each Department. The Budget is amended based on revenues and expenditures, how they came in, and the projection for the last month of the fiscal year. There was a budget freeze put on for the last month but there are some ongoing expenses. The total budget amendment is for $567,500. That doesn't mean the City went $567,500 over budget. A good portion of that, $270,000, was for the purchase of the Rosenlof property, which was not budgeted for and came as a loan from the Sewer Fund. - Herb Basso asked if all the amendments reflect some action that the Council took previous. Did the Council say they would approve this purchase and the budget will be amended later? - Brock Jacobsen said yes. He said there was a couple of these that through the budget the Court is amending the State Fund Collections. The Court is extremely busy and the revenue increased. We have also seen on the fines, our revenue is higher and also the expenses that we have to remit to the State, so we amended the Court budget that way. Administration is mainly for the Rosenlof property. The City doesn't budget for fuel for the Police Department. It also gives a credit to Ivins City when they bill Santa Clara City and they give a credit to the City on that last bill. He said they haven't put a budget to the fuel in the past because it should be covered in the Police billing that the City submits to them. The fuel bill is about $30,000 give or take how well they use the City's fuel. It is a better rate than going to the gas station. There have been spurts when the Police haven't been using it as much and Ed Dickie, City Manager, will make a phone call to the Police Chief to find out why. - Herb Basso said it should be an exception, not a convenience that they go somewhere else. It is not that hard to plan. What is the difference in cost? - Brock Jacobsen said that he didn't know. Bradi handles that. He will need to look at the report. He said that the Fire expenditure changes are the next largest after Administration mainly due to the successful wildlands season they had last year. From what we budgeted in additional wages, but also some repairs and expenses they had and then the capital equipment with the purchase of the Razor that we purchased and outfitted for the Off Road South Hills Rescue. Building, zoning and planning had increased expenses, some professional services, legal services. There were improvements to Town Hall here in the Chambers. Public works, curb and gutter for Canyon View Drive. Parks, utilities, this is really just an accounting, how Brad Hays decided to account for it. Last year, his budget was split into two budgets: Sports and Maintenance. About halfway through the year Brad decided he was going to account for all the utilities not separate them all in one. He wanted to keep them all in Parks. That's why his utility budget is being amended. Swiss Days has an increased cost for entertainment and rentals. Professional services costs are for Lanie and Brooke. Economic Development: we had the Santa Clara Pageant. This is mainly taking care of the float and other costs associated with putting on the pageant, rental of the High School and then there was the Rap Tax donation. - Herb Basso asked who the Rap Tax money was donated to. - Brock Jacobsen said that the donations were to Tuacahn, the Days of 47 and Kayenta. All donations are running through the Economic Development Budget. The last page shows the amended Impact Fees, with Gubler park improvements, building permits. There were 85 building permits and we budgeted for 40. - Tode Hafen asked how the Fire Crews were doing this year. - Brock Jacobsen said the Pine Valley fire is the first one that they've been on. They put in the majority of their last pay period working on this fire. They are still there. It is just starting for them. The Fire Department is going to purchase a new truck this next year. - Tode Hafen mentioned that no citizens came for the Public Hearing and asked if anyone there had any more comments. 5:14 pm Public Hearing Closed. - At 5:14 p.m. Ken Sizemore arrived at the meeting. B. General Business: 1. Consider Approval of the 2015-2016 Operating and Capital Budget and Approve Ordinance 2016-08. - Ken Sizemore asked about the Fines and Forfeitures and asked if that was due to the growth in the case load. - Brock Jacobsen said yes so increased revenue also increases the amount that the City has to remit to the State. - Ken Sizemore asked if the City is really getting that many more citations. - Brock Jacobsen said based on the reports that he gets each month it's 2 to 1 or more for Ivins City. Most of them are traffic but there has been an increase in arrest. Right now Santa Clara is averaging about 125-150 citations a month. - Ken Sizemore asked about the Refuse Collection. Why did that go up? - Brock Jacobsen said that the increase in revenue is probably based on growth. - Ken Sizemore asked how the $567,000 difference compare to previous years. Are we in the neighborhood? - Brock Jacobsen said that it is higher but the majority of that due to the transfer for purchasing of the property across the street. This is higher than normal. He said that he and Ed Dickie would like to get this down much lower every year. $100,000 or less would be the ideal number to be within. - Herb Basso had a suggestion for Brock to create a report throughout the year and throughout the year the Council could take care of things with a Budget Amendment. - Brock Jacobsen said that they can do that. He said that sometimes he errs on the side of caution with this making sure that the City doesn't end up over budget and get a fining and letter from the State. He said that $567,500 is a little bit cautious. - Tode Hafen asked Brock if he has any figures on the sales tax on Harmons. - Brock Jacobsen said that he just got the distribution and he believes they were $18,500 for the month of April. It's less than what we were hoping to see which was closer to $30,000 a month. The Highway 91 project really hurt them. - Tode Hafen said that hopefully we are still working on that and in the newsletter encourage people about shopping locally. She is trying to promote that by word of mouth where she can. People haven't made the connection that there is such a benefit to Santa Clara to shop locally. We have some work to do and we really need to push that through. Our residents can do a better job of shopping locally. They are not aware of what a difference it makes. - Brock Jacobsen said he will get with Ed Dickie and do some research. We'll get some numbers and find the benefit it has to shopping locally. ****Motion to Approve the 2015-2016 Operating and Capital Budget and Approve Ordinance 2016-08. Motion by Herb Basso, seconded by Ken Sizemore. Voting Aye: Jerry Amundsen, Tode Hafen, Jarett Waite, Ken Sizemore and Herb Basso. Voting Nay: None. Motion Carried. 4. Executive Session: None - Brock Jacobsen said that Mary Jo Hafen and the Mayor will be out of town for the City Council meeting next week. The Council needs to make sure they have a quorum. He said that Chris explained to him that at the meeting they will appoint somebody to be in place for the Mayor. - Jarett Waite asked if there were any updates on the plans for punching through to the north for the road for Cobble Creek. - Brock Jacobsen said that is on the agenda for next week and the people came and met with Staff Tuesday morning. They had a good discussion. Right now the discussion is putting the road through to Paradise Village and also working with putting some asphalt on Patricia Lane and the School District was willing to participate to put in curb and gutter on that east side of it and Cobble Creek would put in 28 feet of asphalt along Patricia. That was the initial discussion. Patricia is a dedicated road. Staff recommends not having a crash gate between Cobble Creek and Paradise Village. - Ken Sizemore asked about the cell phone tower. Why does Verizon want to put it there in the first place? - Jerry Amundsen said that he surmises that there are dark spots here in the valley and it's going to be put there to take care of those. - Melodee Hayes said they are willing to put it there because that is the easiest, most clear spot. For improved service for everyone. She said that when they sent out the notification for the Planning Commission meeting, no one had responded prior to that meeting and then it was the residents in St. George that opposed it. They are actually the ones that are appealing it. Corey Bundy has had her send everything to Matt Ence so it will be all ready for the hearing. - Tode Hafen asked if Verizon was planning on camouflaging it in any way. - Melodee Hayes said that at Planning Commission Verizon said that they don't want to really disguise it because it would look like a big ugly fake tree. She put the minutes to the Meeting in the Council's drop box. - Tode Hafen asked how many cell towers there are in Santa Clara right now. - Brock Jacobsen said there are three locations: the little league field, Circle Drive Fire Station and at Gubler Park. - Tode Hafen said that obviously Verizon is aware of the opposition. Are there any other locations? Are they willing to move it? - Melodee Hayes said not so much because they already have done the studies: the FAA, the EPA and all that research and they have already signed the lease. The homeowners in St. George say that it will impact their view the most. Verizon is saying they legally can't budge. They are saying that this spot will have the least impact. The height will be 80 feet. 5. Adjournment: Motion to adjourn by Jerry Amundsen. Seconded by Herb Basso with all members present voting aye.
