ESCALANTE CITY PLANNING AND ZONING
APRIL 26, 2016
WORK MEETING - 6:00 P.M.
REGULAR MEETING - 7:00 P.M.
ESCALANTE CITY COUNCIL CHAMBERS - 56 N. 100 W.
Chairman Tony Peterson called the work meeting to order at 6:00 p.m. in the Escalante City Council Chambers.
Present at said work meeting were Chairman Peterson, Commissioners Marlene Stowe,
Elaine Lott, Terry Olsen, Tara Woolsey, Ed O'Kane, Lawrence Barnes and City Recorder Stephanie Steed.
Also present were Jenae Westhoff, Steve Westhoff, Leslie Venuti, Ben Venuti, Joby Venuti, Steve Seymour, Jeanne Seymour, Bob Hartman, Tom Mansell, Howard Hutchison,
Ryan Cottam, Emilee L. Woolsey, Dana Waggoner and Brent Cottam.
The work meeting was to review projects on the agenda, discussion on a Planned Unit Development with Steve & Jenae Westhoff on property located at 680 West Highway 12 (proposal attached) and review the ordinances.
The work meeting was adjourn at 7:00 p.m.
Chairman Peterson called the regular meeting to order at 7:00 p.m.
Present at said regular meeting were Chairman Peterson, Commissioners Lott, Stowe, Woolsey, Olsen, O'Kane, Barnes and City Recorder Steed.
Also present were Jenae Westhoff, Steve Westhoff, Leslie Venuti, Ben Venuti, Joby Venuti, Steve Seymour, Jeanne Seymour, Bob Hartman, Tom Mansell, Howard Hutchison,
Ryan Cottam, Emilee L. Woolsey, Dana Waggoner, Brent Cottam, Catherine Barney,
Clark Barney and Terrence Tontlewicz.
ADOPTION OF THE AGENDA
Commissioner Woolsey made a motion to adopt the agenda as written. Commissioner Olsen seconded the motion. Motion carried with Commissioners O'Kane, Woolsey, Olsen, Lott and Barnes voting aye.
APPROVAL OF MINUTES
MINUTES OF THE APRIL 12, 2016 MEETING
Commissioner Barnes made a motion to approve the minutes of the April 12, 2016
meeting as written. Commissioner Lott seconded the motion. Motion carried with Commissioners Woolsey, O'Kane, Olsen, Lott and Barnes voting aye.
PUBLIC COMMENTS
TOM MANSELL
Mr. Mansell said he and some other Business Owners have been talking to the City Council about Holiday Homes. Mr. Mansell feels the City needs to look at the Holiday Homes. Mr. Mansell said we need to make sure the General Plan is in conjunction to have Holiday Homes. Mr. Mansell said he feels the City will have problems with College Kids renting Holiday Homes.
Mr. Mansell said Holiday Homes are not paying taxes or demand charge on their meters.
Mr. Mansell said he hopes the Commission will consider his concerns and work with the Council on them.
DANA WAGGONER
Ms. Waggoner said she is the owner of Escalante Outfitters. Ms. Waggoner said the people have found this place. Ms. Waggoner said there is great opportunity with this season. Ms. Waggoner said we need more property and rentals, but need to be thoughtful. Ms. Waggoner said she is concerned about Holiday Homes. Ms. Waggoner said she added a new cabin and went through the County. Ms. Waggoner said she also had to comply with the ADA laws which made her cabin a lot more expensive. Ms. Waggoner said she just wants an even playing field. Ms. Waggoner said if people are renting Holiday Homes, they need to pay taxes and commercial water and sewer rates. City Recorder Steed explained in January she and Council member Graham went through the City accounts and changed all Business to Commercial. City Recorder Steed explained the City has to do a report every year and classify Residential and Commercial users. City Recorder Steed also explained anyone in business has to have a Business License and a Sales Tax Number. City Recorder Steed said she has sent out two letters to Business Owners requesting them to come in compliance and get a Business License.

Commissioner Olsen made a motion to approve the Conditional Use Permit in accordance with chapter 22.3.8, 22.7, 7.5, and Chapter 8 of the Planning and Zoning Ordinances. Commissioner O'Kane seconded the motion. Motion carried with Commissioners Barnes, Olsen, O'Kane, Woolsey and Lott voting aye.
HIGH ADVENTURE BED AND BREAKFAST - 40 S. 200 W.
This item was reviewed during the work meeting and meets all requirements. This Business License goes with the Conditional Use Permit above. Commissioner Woolsey made a motion to approve the Business License in accordance with the Business License Ordinances. Commissioner Olsen seconded the motion. Motion carried with Commissioners Barnes, Woolsey, Olsen, Lott and O'Kane voting aye.
BRENT COTTAM - CONDITIONAL USE PERMIT - 609 EAST HIGHWAY 12
This item was reviewed during the work meeting and meets all requirements.
Commissioner Barnes made a motion to approve the Conditional Use Permit for
Mr. Cottam in accordance with chapter 22.8, 22.4, 22.5, 22.3.8, 22.6.2 and Chapter 8
of the Planning and Zoning Ordinances. Commissioner Woolsey seconded the motion. Motion carried with Commissioners Woolsey, Olsen, Lott, O'Kane and Barnes voting aye.
BRENT COTTAM - HOTEL AND CABINS - 609 EAST HIGHWAY 12
This item was reviewed during the work meeting and meets all requirements. This project goes with Mr. Cottam's Conditional Use Permit. Commissioner Woolsey made a motion to approve the Municipal Project Approval Form for Mr. Cottam in accordance with chapter 22.8, 22.4, 22.5, 22.3.8 and 22.6.2 of the Planning and Zoning Ordinances. Commissioner O'Kane seconded the motion. Motion carried with Commissioners O'Kane, Barnes, Woolsey, Lott, and Olsen voting aye.
ANDY FERRIGNO & SANDY ESQUE - REMODEL, ELECTRICAL, PLUMBING,
CHIMNEY - 180 WEST 300 NORTH

Commissioner Lott made a motion to approve the Municipal Project Approval Form for Mr. Ferrigno and Ms. Esque in accordance with chapter 1.6 of the Planning and Zoning Ordinances. Commissioner Barnes seconded the motion. Motion carried with Commissioners Lott, Olsen, O'Kane, Barnes, and Woolsey voting aye.
BEN VENUTI - 235 NORTH 400 WEST AND 245 NORTH 400 WEST
Joby Venuti said his brother Ben has purchased properties at 235 North 400 West and 245 North 400 West and they are trying to find out what they can do on it. Mr. Venuti said they are looking for advice and what the City wants. Mr. Venuti said they would like to put some commercial nightly rentals in. Mr. Venuti said their property is in the RR-120 zone. Mr. Venuti said density of land can be no more than 25 percent and no higher than 10 percent is residential. Mr. Venuti said they have two four acre parcels, but would like to operate them as one. Mr. Venuti said this would give him the opportunity to build more cabins. Mr. Venuti said the property has electrical, telephone, water and sewer. City Recorder Steed said at this time there is no water or sewer on either parcel. Zoning change and lot adjustment were discussed. This item was discussed at length and City Recorder Steed will contact David Church to see what he recommends.

Commissioner Woolsey made a motion to adjourn the meeting at 7:44 p.m.
Commissioner O'Kane seconded the motion. Motion carried all in favor.
