PRESENTATIONS:
1.	PRESENTATION BY CHRIS VANCAMPEN REGARDING THE NORTH DAVIS REPORTER NEWSPAPER

	BACKGROUND: A new monthly newspaper serving residents in Clearfield, Sunset, Syracuse, West Point and Clinton had been established. Chris VanCampen is present to introduce the publication to the Community and the Council. 

SCHEDULED ITEMS:
2.	APPROVE AGREEMENTS WITH UTAH DEPARTMENT OF TRANSPORTATION (UDOT) AND CNA REGARDING THE REPAIR OF THE 200 SOUTH OVERPASS

CONSIDERATION FOR ADOPTION OF RESOLUTION 2009R-20 OF THE CITY COUNCIL OF CLEARFIELD CITY, UTAH (THE “ISSUER”), FINALIZING THE TERMS AND CONDITIONS OF THE ISSUANCE AND SALE BY THE ISSUER OF ITS SALES TAX REVENUE BONDS, SERIES 2009 IN THE AGGREGATE PRINCIPAL AMOUNT OF APPROXIMATELY $2,371,000 (THE  “SERIES 2009 BONDS”); AWARDING AND CONFIRMING THE SALE OF SAID SERIES 2009 BONDS; AUTHORIZING THE EXECUTION BY THE ISSUER OF A THIRD SUPPLEMENTAL INDENTURE OF TRUST AND OTHER DOCUMENTS REQUIRED IN CONNECTION THEREWITH; AUTHORIZING THE TAKING OF ALL OTHER ACTIONS NECESSARY TO THE CONSUMMATION OF THE TRANSACTION CONTEMPLATED BY THIS RESOLUTION; PROVIDING A SEVERABILITY CLAUSE; REPEALING RESOLUTIONS IN CONFLICT; PROVIDING AN EFFECTIVE DATE; AND RELATED MATTERS

	BACKGROUND: The City intends to bond to facilitate the repair or multiple roads located within the City boundaries.

	RECOMMENDATION: Approve Resolution 2009R-20 of the City Council of Clearfield City, Utah (the “Issuer”), Finalizing the Terms and Conditions of the Issuance and Sale by the Issuer of its Sales Tax Revenue Bonds, Series 2009 in the Aggregate Principal Amount of approximately $2,371,000 (the “Series 2009 Bonds”); Awarding and Confirming the Sale of said Series 2009 Bonds; Authorizing the Execution by the Issuer of a Third Supplemental Indenture of Trust and other documents required in connection therewith; Authorizing the taking of all other actions necessary to the Consummation of the Transaction contemplated by this Resolution; Providing a Severability Clause; Repealing Resolutions in Conflict; Providing an Effective Date; and Related Matters and authorize the Mayor’s signature to any necessary documents. 

5.	REVIEW AMENDMENTS TO CLEARFIELD CITY’S COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) ONE-YEAR ACTION PLAN FOR PROGRAM YEARS 2006-2007, 2007-2008, 2008-2009 AND 2009-2010

BACKGROUND: Council has received a copy of the proposed amendments to the 2006-2007, 2007-2008, 2008-2009, 2009-2010 Community Development Block Grant (CDBG) One-Year Action Plans. Citizens are given the opportunity to review the amendments in the Community Development Department which began June 29, 2009. A public hearing will be held August 11, 2009 to finalize the amendments.

	RECOMMENDATION: Review and discuss amendments.

6.	APPROVE THE AWARD OF BID FOR THE ROADWAY IMPROVEMENT PROJECT TO INSTALL ASPHALT OVERLAY AND/OR REPAIR THE PAVEMENT, CURB AND GUTTER TO VARIOUS STREETS WITHIN THE CITY

	BACKGROUND: Bids were received from six contractors for the Roadway Improvement Project to overlay and/or repair the pavement, curb and gutter to various streets within the City. The City Engineer has reviewed the bids and recommends awarding the bid to Staker Parson Companies with the bid amount of $1,602,585.80.

	RECOMMENDATION: Approve the award of bid for the Roadway Improvement Project to install asphalt overlay and/or repair the asphalt, curb and gutter to various streets within the City and approve funding the project at $1,602,585.80, bid amount of Staker Parson Companies, engineering and contingency fees of $597,415 for a total project cost of $2,200,000.80 and authorize the Mayor’s signature to any necessary documents. 



7.	APPROVE THE AWARD OF BID FOR THE PURCHASE OF A KUBOTA UTILITY VEHICLE

	BACKGROUND: Bids were received for the purchase of a Kubota Utility Vehicle to be used by the Community Services Department, Parks Division. Bids were received from three vendors. The bids have been reviewed by Larry Singleton, Fleet Manager, and he recommends awarding the bid to Bonneville Equipment Company of Sandy, Utah which was the vendor with the lowest bid amount meeting the bid specifications with a bid amount of $17,462.

	RECOMMENDATION: Approve the award of bid for the purchase of a Kubota Utility Vehicle for the Community Services Department to Bonneville Equipment Company with a bid amount of $17,462 and authorize the Mayor’s signature to any necessary documents.

8.	APPROVE THE CONTRACT TIME EXTENSION WITH CALDWELL RICHARDS SORENSEN (CRS) FOR CONSULTANT SERVICES FOR CONSTRUCTION OF THE RAIL TRAIL

	BACKGROUND: Because of the construction issue concerning the capping of the ballast on the Rail Trail and the time it took to resolve the issue, a time extension is needed for the project. No additional funds were specifically required for the time extension. 

	RECOMMENDATION: Approve the contract time extension for the Rail Trail and authorize the Mayor’s signature to any necessary documents.

9.	APPROVAL OF RESOLUTION 2009R-19 PERMITTING THE CLEARFIELD CITY POLICE DEPARTMENT TO DISPOSE OF UNCLAIMED PROPERTY

BACKGROUND:  The Clearfield City Police Department has unclaimed property it would like to donate to charity. State Law allows the City to appropriate such property for public interest use to a bona fide charity if it has been retained for longer than 90 days and proper notice has been made.  The City has met all of the requirements. 

RECOMMENDATION: Approve Resolution 2009R-19 permitting the Clearfield City Police Department to dispose of unclaimed property and authorize the Mayor’s signature to any necessary documents. 

10.	APPROVE A UTILITY AND DRAINAGE EASEMENT NECESSARY FOR CONSTRUCTION OF THE DAVIS COUNTY HEALTH DEPARTMENT BUILDING TO BE LOCATED AT APPROXIMATELY 22 SOUTH DEPOT STREET 

	BACKGROUND:  This utility and drainage easement grants public and/or private utility companies authorization to install, construct, reconstruct, operate, maintain, repair, replace, enlarge and remove all public and private utilities in preparation for the construction of the Davis County Health Building located at approximately 22 South Depot Street. This easement is for an area east of the proposed Davis County Health Department Building.

	RECOMMENDATION: Approve a utility and drainage easement necessary for construction of the Davis County Health Department Building to be located at approximately 22 South Depot Street and authorize the Mayor’s signature to any necessary documents. 

11.	APPROVE A UTILITY EASEMENT NECESSARY FOR CONSTRUCTION OF THE DAVIS COUNTY HEALTH DEPARTMENT BUILDING TO BE LOCATED AT APPROXIMATELY 22 SOUTH DEPOT STREET 

	BACKGROUND: This utility easement grants public and/or private utility companies authorization to install, construct, reconstruct, operate, maintain, repair, replace, enlarge and remove all public and private utilities in preparation for the construction of the Davis County Health Building located at approximately 22 South Depot Street. This easement is located just north of the 200 South overpass. 

	RECOMMENDATION: Approve a utility easement necessary to construction of the Davis County Health Department Building to be located at approximately 22 South Depot Street and authorize the Mayor’s signature to any necessary documents.

**ADJOURN AS THE CITY COUNCIL AND RECONVENE AS THE CDRA**

1.	APPROVE THE MINUTES FROM THE CLEARFIELD COMMUNITY DEVELOPMENT AND RENEWAL AGENCY (CDRA) MEETING HELD ON JUNE 23, 2009 

2.	APPROVE TWO UTILITY AND DRAINAGE EASEMENTS NECESSARY FOR THE CONSTRUCTION OF THE DAVIS COUNTY HEALTH DEPARTMENT BUILDING TO BE LOCATED AT APPROXIMATELY 22 SOUTH DEPOT STREET 

	BACKGROUND:  These utility and drainage easements grant public and/or private utility companies authorization to install, construct, reconstruct, operate, maintain, repair, replace, enlarge and remove all public and private utilities in preparation for the construction of the Davis County Health Building located at approximately 22 South Depot Street. One easement is for an area east of the proposed Davis County Health Department Building and the other is for an area west of the proposed building.

	RECOMMENDATION: Approve two utility and drainage easements necessary for the construction of the Davis County Health Department Building to be located at approximately 22 South Depot Street and authorize the Direcotor’s signature to any necessary documents. 

3.	APPROVE A RAILROAD ACCESS EASEMENT AGREEMENT WITH THE UTAH TRANSIT AUTHORITY (UTA) NECESSARY FOR CONSTRUCTION OF THE DAVIS COUNTY HEALTH DEPARTMENT BUILDING TO BE LOCATED AT 22 SOUTH DEPOT STREET

	BACKGROUND: Utah Transit Authority (UTA) has used a portion of property currently owned by the Community Development and Renewal Agency (CDRA) for access to its commuter rail line and associated equipment. This agreement formally grants a private railroad access easement in preparation for construction of the Davis County Health Department Building to be located at 22 South Depot Street.  

	RECOMMENDATION: Approve a railroad access easement agreement with the Utah Transit Authority (UTA) necessary for construction of the Davis County Health Department Building to be located at 22 South Depot Street and authorize the Director’s signature to any necessary documents.
