AN ORDINANCE OF THE MOAB CITY COUNCIL ENACTING SUBSECTION 2.28.110.G OF THE MOAB CITY CODE TO ESTABLISH SPECIFIC PROCEDURES FOR THE PROCUREMENT OF LOBBYIST SERVICES
RECITALS
WHEREAS, Moab City is a municipality with broad authority to contract for professional services; and
WHEREAS, the Moab City Council deems it necessary to amend Section 2.28.110 of the Moab Municipal Code to enact specific procedures for the procurement of lobbyist services.
NOW, THEREFORE, BE IT ORDAINED by the Moab City Council that:
1. Enactment. Subsection 2.28.110.G of the Moab Municipal Code is enacted to read:
'G. Lobbyist Service Contracts. The following provisions shall govern the procurement of lobbyist services:
1. The City may only award a contract for lobbyist services that exceeds the procurement thresholds in Section 2.28.050 without using a competitive proposal or bid process if the City Manager, after consulting with the Mayor and the City Council on an individual basis, determines in writing that awarding a contract for lobbyist services through a competitive procurement process is impractical and not in the best interests of the City.
2. The City shall award all contracts for lobbyist services regardless of their amount based on professional qualifications, experience, and ability to meet the City's specific service requirements, cost of service, and other criteria deemed important by the City Manager in consultation with the Mayor and City Council on an individual basis.
3. All contracts for lobbyist services regardless of their amount shall include a specified term not to exceed five years.
4. The City Council shall approve all contracts for lobbyist services that exceed the procurement thresholds set forth in Section 2.28.050.
5. Any person(s) or firm(s) providing lobbyist services to the City shall provide such services as independent contractors and not as City employees.'
2. Severability. If a court of competent jurisdiction determines that any part of this Ordinance is unconstitutional or invalid, then such portion of this Ordinance, or specific application of this Ordinance, shall be severed from the remainder, which shall continue in full force and effect.
3. Direction to Mayor and Staff: The Mayor and staff are authorized and directed to take such steps as may be needed: (a) for this Ordinance to become effective under Utah law, including but not limited to compliance with the posting requirements of Utah Code §§ 10-3-711 and 63G-30-102; (b) to revise the Moab Municipal Code to include the language enacted by this Ordinance, including any non-substantive revisions that may be needed to renumber and reformat the Moab Municipal Code or to correct any scrivener's errors.
4. Effective Date. This Ordinance will take effect immediately upon its posting pursuant to Utah Code §§ 10-3-711 and 63G-30-102.
