Approving and Adopting the
Amended Milford II Community Reinvestment Project Area Plan
Pursuant to Title 17C. Limited Purpose Local Government Entities - Community
Reinvestment Agency Act and specifically 17C-5-110, as well as the noticing requirements
in 63G-30-102, Utah Code Annotated 1953, as amended, the County Commission of Beaver
County (the 'Legislative Body') is providing this notice with respect to Ordinance No. 2025-
03 which was passed by the Legislative Body on May 20, 2025, adopting the official
Amended Milford II Community Reinvestment Project Area Plan (the 'Official Plan'), as
approved by the Community Development and Renewal Agency of Beaver County (the
'Agency') on the same date, and directing that notice of adoption of the Official Plan as
required by law. Ordinance No. 2025-03 and the Official Plan shall become effective upon
publication of this notice, at which time the Agency may proceed to implement the Official
Plan.
The Official Plan in its entirety is available for public inspection at the County Offices at 105
E Center St, Beaver, UT 84713 during regular office hours, (Monday-Thursday: 8am - 5pm,
Friday: 8am - 12pm).
Summary of Ordinance No. 2025-03 of the County Commission of Beaver County to
the Adoption of the
Amended Milford II Community Reinvestment Project Area Plan
Ordinance No. 2025-03 of the County Commission of Beaver County approved the
Amended Milford II Community Reinvestment Project Area Plan as the 'Official Plan' of the
Milford II Solar CRA. As outlined in 17C-5-112, the ordinance did not require a public hearing,
given that 1) the amendment did not propose a larger geographic area, and 2) the
amendment did not allow the Agency to receive a greater amount of project area funds. An
Amended Project Area Budget was also drafted, considered and adopted by the Agency,
outlining the specific time period of taxing entity participation, percentages, and amount of
tax increment to be used to meet the objectives of the Official Plan.
For a period of 30 days after the date of adoption of the Official Plan, any person in interest
may contest the Official Plan or the procedure used to adopt it if the Official Plan or
procedure fails to comply with applicable statutory requirements. After expiration of that 30-
day period, no person may contest the Official Plan or procedure used to adopt it for any
cause.
This Notice is provided May 29, 2025, and will be posted on the Utah Public Notice Website
in addition to the County's website.
