$2,384,511 The Preparedness Executive met on 5/27 and approved that the Hospital Preparedness Program (HPP) go before Governance for continuation grant approval with the same budget and workplan as last year. Prep exec Brian Cowan made the motion, Heather Borski second, all in attendance agreed. This is the continuing application for the 2nd year in a 5-year project period of the Administration for Strategic Preparedness and Response (ASPR) Hospital Preparedness Program (HPP), a cooperative agreement program that, through its support for health care coalitions (HCCs), prepares the health care delivery system to save lives during emergencies that exceed the day-to-day capacity of health care and emergency response systems.

(These were approved previously but had to lapse because of the litigation and legislative session. It's all the same information as before, with the addition of the criminal code recodification creating the need for us to update some of the code references in the rules, particularly in the definition sections.)

R384-324 Tobacco Product, Electronic Cigarette Product, and Nicotine Product Retailer Permit Process The amendment changes the definition of a retail tobacco specialty business to remove the provision that it is a location where a flavored electronic cigarette product is sold, as it will be illegal to sell flavored electronic cigarette products, other than tobacco or menthol flavored products, as of January 1, 2025. The amendment also updates criminal code references changed by HB21(2025) and corrects grammatical errors in the text.

Requirements to Sell Electronic Cigarette Products This filing changes the terminology for prohibited sales to align with the Utah Code by reiterating that a retailer is prohibited from selling a product that is not a premarket authorized or pending electronic cigarette product (as defined in Utah Code 76-10-101). This filing also changes R384-415-8 to indicate that both manufacturers sealed electronic cigarette products and nonmanufacturer sealed electronic cigarette substances are subject to the same requirements. This filing revises product quality requirements to align with changes made by SB61(2024) by redefining exemptions from violations. The amendment also updates criminal code references recodified HB21 (2025).
