PRESENTATIONS
1. PRESENTATION TO THE COMMUNITY SERVICES DEPARTMENT FOR THE 'INNOVATION OF THE YEAR' AWARD FOR ROSILI'S PLAYGROUND AT BICENTENNIAL PARK

PUBLIC HEARINGS:
3. PUBLIC HEARING TO RECEIVE PUBLIC COMMENT ON THE AMENDMENT TO THE WILCOX FARMS SUBDIVISION DEVELOPMENT AGREEMENT FOR THE PROPERTY LOCATED AT APPROXIMATELY 1550 SOUTH 1000 WEST
BACKGROUND: In 2022, Destination Homes entered into a development agreement with Clearfield City for the development of a 101-lot single-family subdivision. Destination Homes is seeking to partner with a national home builder in an arrangement where Destination Homes would remain as the developer ultimately responsible for all horizontal improvements such as roads, sidewalks, and common open space. Proposed amendments include adjusting open space amenities and layouts, porch encroachments, and private street corner setbacks. Additionally, the Planning Commission recommended that the applicant include additional details to the proposed amendments to ensure that any new home plans meet intent and architectural standards of the original agreement.
RECOMMENDATION: Receive public comment.
4. PUBLIC HEARING TO RECEIVE PUBLIC COMMENT ON THE VACATION OF A PUBLIC UTILITY EASEMENT WITHIN WILCOX FARMS SUBDIVISION
BACKGROUND: In 2000 a subdivision plat for Wilcox Farms Subdivision Amended was recorded. The subdivision plat included a public utility easement along the rear of lots 10, 11, 12. These lots were never built on, and subsequently, an amended plat, known as Wilcox Farms Residential Subdivision has been recorded. The unused easement is impacting lots 120, 131, 133 of the new subdivision and needs to be vacated. There is no negative impact from the action and no future plans for the easement.
RECOMMENDATION: Receive public comment.

The Open Comment Period provides an opportunity to address the Mayor and City Council regarding concerns or ideas on any topic relevant to City business. To be considerate of everyone at this meeting, public comment will be limited to three minutes per person. Participants are to state their names for the record. Comments, which cannot be made within these limits, should be submitted in writing to the City Recorder at nancy.dean@clearfieldcity.org.

6. CONSIDER APPROVAL OF ORDINANCE 2025-15 APPROVING THE AMENDMENTS TO THE WILCOX FARMS SUBDIVISION DEVELOPMENT AGREEMENT FOR THE PROPERTY LOCATED AT APPROXIMATELY 1550 SOUTH 1000 WEST
RECOMMENDATION: After careful consideration of the information presented, the Clearfield City Council moves to:
1. Approve Ordinance 2025-15 approving the amendments to the Wilcox Farms Development Agreement for the property located at approximately 1550 South 1000 West and authorize the mayor's signature to any necessary documents;
2. Deny Ordinance 2025-15 approving the amendments to the Wilcox Farms Development Agreement for the property located at approximately 1550 South 1000 West and authorize the mayor's signature to any necessary documents; or
3. Table consideration of Ordinance 2025-15 approving the amendments to the Wilcox Farms Development Agreement and request additional time to consider the proposal.
7. CONSIDER APPROVAL OF ORDINANCE 2025-14 VACATING AN UNUSED PUBLIC UTILITY EASEMENT ESTABLISHED UNDER THE OBSOLETE SUBDIVISION PLAT FOR WILCOX FARMS SUBDIVISION AMENDED
RECOMMENDATION: Approve Ordinance 2025-14 vacating an unused public utility easement established under the obsolete subdivision plat for Wilcox Farms Subdivision Amended, and authorize the mayor's signature to any necessary documents.
8. CONSIDER APPROVAL OF ORDINANCE 2025-13 TERMINATING AND DISSOLVING REDEVELOPMENT PROJECT AREA 7 WITHIN THE WESTSIDE CENTRAL BUSINESS DISTRICT REDEVELOPMENT PROJECT AREA PLAN
BACKGROUND: The Clearfield Community Development and Renewal Agency and Clearfield City adopted a Project Area Plan for the Westside Central Business District Project Area. The RDA project was approved to run for a 25-year term and has now expired. Pursuant to State statute, a project area remains in existence until an ordinance is adopted by the legislative body
RECOMMENDATION: Approve Ordinance 2025-13 terminating and dissolving Redevelopment Project Area 7 within the Westside Central Business District Redevelopment Project Area Plan, and authorize the mayor's signature to any necessary documents.
9. CONSIDER APPROVAL OF RESOLUTION 2025R-07 AUTHORIZING AN INTERLOCAL AGREEMENT WITH DAVIS COUNTY FOR ELECTION ADMINISTRATION SERVICES
BACKGROUND: The City has successfully conducted its municipal elections by mail for the last several years with the assistance of the Davis County Clerk's office. The County has the resources and expertise necessary to continue to assist in administering the elections by mail. The Interlocal Agreement identifies the services provided by the County Clerk's office. The City Recorder continues to act as the City's election officer providing services to candidates and voters, establishing an election plan, and all other election duties and responsibilities as required by State Statute.
RECOMMENDATION: Approve Resolution 2025R-07 authorizing an Interlocal Agreement with Davis County for Election Administration Services and authorize the mayor's signature to any necessary documents.
10. CONSIDER APPROVAL OF THE SANITARY SEWER MANAGEMENT PLAN (SSMP) AND THE MUNICIPAL WASTEWATER PLANNING PROGRAM (MWPP) REPORT
BACKGROUND: The Utah Division of Water Quality requires the legislative body of each jurisdiction that has a sanitary sewer collection system to establish and adopt the SSMP every five years and the MWPP annually in a public meeting. The main purpose of the SSMP is to provide a five-year plan and schedule to properly manage, operate, and maintain all parts of the sewer collection system to reduce and prevent sanitary sewer overflows (SSO), as well as minimize impacts of any SSOs that occur. The MWPP is an annual survey that reviews the operations of the city's sanitary sewer system to ensure that City Council is aware of the current needs and conditions of the wastewater system.
RECOMMENDATION: Approve the Sanitary Sewer Management Plan and the Municipal Wastewater Planning Program report and authorize the mayor's signature to any necessary documents.
