NOTICE OF AMENDMENT TO INTERLOCAL AGREEMENT
NOTICE IS HEREBY GIVEN that on May 14, 2025, the City of South Salt Lake, Utah (the 'City') and the Redevelopment Agency of South Salt Lake, Utah (the 'Agency'), adopted a resolution (the 'Resolution') approving an amendment (the 'Third Amendment') to the Interlocal Agreement previously entered into by the City and the Agency dated September 22, 2010 (collectively, as amended, the 'Interlocal Agreement'), under Title 11, Chapter 13, Utah Code Annotated 1953, as amended ('Utah Code') (the 'Interlocal Cooperation Act'), and pursuant to which the City has pledged the municipal energy sales and use tax revenues received by the City pursuant to Title 10, Chapter 1, Part 3, Utah Code and the municipal telecommunications license tax received by the City pursuant to Title 10, Chapter 1, Part 4, Utah Code (together, the 'Excise Taxes') to secure the issuance and repayment of certain bonds previously issued by the Agency.
The Third Amendment provides for a subordinate pledge of the Excise Taxes for a limited time to provide additional security for the payment of debt service on the Agency's Tax Increment Revenue Bonds, Series 2025.
The term of the Interlocal Agreement, as amended by the Third Amendment, commenced on May 15, 2025 and unless amended, shall remain in effect until the earlier of November 1, 2030 or the date that any Series 2025 Bonds are no longer outstanding.
A copy of the Resolution and the Interlocal Agreement are on file in the office of the City Recorder, at 220 East Morris Avenue, Suite 200, South Salt Lake, Utah, where they may be examined during regular business hours of the City, Monday through Friday from 8:00 a.m. to 5:00 p.m., for a period of at least thirty (30) days from and after the date of publication of this notice.
NOTICE IS FURTHER GIVEN that a period of 30 days from and after the date of the publication of this notice is provided by law during which any person in interest shall have the right to contest the legality of the Resolution or the Interlocal Agreement and that after such time, no one shall have any cause of action to contest the regularity, formality, or legality thereof for any cause whatsoever.
