PURPOSE OF PUBLIC NOTICE
The purpose of this public notice is to declare Utah Division of Water Quality's intention to issue CAFO General Permit coverage to Cal-Maine Foods Inc., Delta Egg Farm (Cal-Maine Foods). The Division of Water Quality is seeking to obtain comments from the public, for a 30-day period, on the Nutrient Management Plan (NMP), which is part of the CAFO permit application for Cal-Maine Foods. As required by 40 CFR 122.23(h)(1) and Utah Admin. Code R317-8-6.5, a site-specific NMP must be public noticed prior to CAFO permit issuance. Certain NMP conditions are permit requirements and therefore the NMP must be public noticed as part of the permit requirements for Cal-Maine Foods.

CAFO PERMIT PERIOD: May 7, 2025 through May 6, 2030.
BACKGROUND
The United States Environmental Protection Agency Region VIII, has delegated the Utah Division of Water Quality (DWQ) to implement the CWA in the state of Utah. At this time, DWQ is preparing to reissue the UPDES General CAFO Permit to Cal-Maine Foods requires public notice of its NMP. The CAFO permit is issued under authority of the Utah Water Quality Act, Utah Code §§19-5-104 and 107, as amended.
Cal-Maine Foods is not required to seek permit coverage at this time, the facility is voluntarily seeking coverage under the CAFO permit. The NMP for Cal-Maine Foods has been approved by a certified planner as required in Utah Admin. Code R317-8-10.6(2). The NMP has been certified by a certified planner to be in compliance with applicable Natural Resources Conservation Service standard practices.
PUBLIC COMMENTS
The CWA and Utah Admin. Code R317-8-6.5 requires that Nutrient Management Plans for proposed CAFO permit coverage shall be public noticed for public comment, and if needed, revised based on any substantive public comments received. The public comments period on the NMP will be May 19, 2025, through June 18, 2025. Comments are invited any time prior to close of business on June 18, 2025.
During the public comment period, any interested person may submit written comments on the NMP and proposed CAFO permit coverage for Cal-Maine Foods. Any interested person may request a public hearing on the permit application if no hearing has already been scheduled. A request for a public hearing shall be in writing and shall state the nature of the issues proposed to be raised in the hearing. All comments will be considered in making the final decision and shall be answered as provided in Utah Admin. Code R317-8-6.12.
