Public Hearing Minutes May 7, 2025 Amalga Town Hall 6590 N 2400 W Amalga, Utah Commission Members: Judy Downs, Chair, April Hansen, Kelly Noble, Mike Diehl, Secretary/Town Board Dave Lee. Caleb Christensen was also there as he will be filling in for Dave Lee in July. Meeting began at 6:30 PM Welcome by Judy Downs Pledge of Allegiance was led by Judy Downs This meeting was convened to discuss 3 proposed changes to the Amalga Town Land Management and Development Code. Judy explained the first proposed change. As per recommendation from the Town Attorney, a complete change to Chapter 6, Zoning Administration and Enforcement was presented. This change to the code would make clear what procedures and process the Planning and Zoning Commission would have to deal with violations. It would also set a clear picture of fines to be assessed. Current Code is very presently very vague. Dave Lee explained how to use the Amalga Town Website, and how to subscribe to the Utah Public Website. Sid Munk presented his proposed change to 8.1 of the Town Code. His proposed change is on the Amalga Town website under Proposed Ordinances. This change would allow farm workers to live in existing renovated buildings. Ken Allsop assisted Sid with the amendment. Diane Morley wanted to know who this specifically applied to. Scott Jenson wondered if this ordinance would apply to other industries. This change applies only to agriculture. Other businesses could present their code amendments. These buildings will require building permits from the county. Judy again explained the process. Mark Cowley wanted to know if the amendment is approved, then in four years the board does not renew the use-what happens? How does it work with taxes? Ken Allsop went on record as being for this amendment. He clarified under what conditions currently mobile homes could be used. The proposed amendment would expand it from mobile homes to an accessory building approved for residential use. It would have to be approved for occupancy by the county. Carl Sims explained his views in favor of this change. Marilyn Munk voiced an opinion as to bringing new mobile homes. This amendment does not address that specific item. Howard Kunz presented his proposed change to 3.16 of the Town Code. His proposed change is on the Amalga Town website under Proposed Ordinances. This change would allow for accessory buildings on a regular lot with a current dwelling. Diane Morley- is this change just for family members or is this open to any rental of any outbuilding. It is open to anyone. There was a question about ARBNB's. Our code does not address that. Question that one could have a detached building or an apartment in the basement but not both. That is correct. Judy Downs-If you have a home and want to rent out your basement of under 1000sq ft, you can do that. It doesn't have to be just family. You must live in your home. If you want to use another building, you can have one but not both. (There were several questions about clearances for accessory buildings. These are found in 7.1.8, and 7.2.8, Yard Requirements - Accessory Buildings) Zoning Clearance is required for any building or renovation before building. DJ Anderson-If this is approved, does it negate Sid's proposal. These two proposals are totally separate. Diane Morley-For this, if it was for a family member, or a child with medical issues. DJ Anderson-Does not 8.1.3 not already cover this item? April Turner-How do towns follow State precedence? State Code is allowing ADU's as extra housing. This would apply to towns over 5000 people. Ed Dursteler? Vic Bingham-Now we want to allow everyone to have another dwelling in their backyard? Ken Allsop-In favor of it. Substantial step for allowing more people to move into the town. Theoretically this could all happen right now, but one of the reasons it won't happen is because people don't want people living in their backyard. He is not in favor of having duplexes when the owner is not on the property. Restriction on this is that the main house has to be occupied by the property owner. If favor of it because it increases affordable housing for people starting in life. Kelly Noble-Not in favor. Judy Downs-Read text from Shane and Tammy Munk. Not is favor. Worried that the voice of the people is not being heard. Concerned about water quality. May have to put in a sewer system at some point. Dave Lee-Read a text from Doug Hansen. Not in favor. Jessica Noble-Not in favor. Judy Downs-Not in favor. Amalga should not be a place for cheap housing. Scott Jenson-Disagrees that 10 people moving in would negatively impact the town. We have had people move in and they have made the community better. Judy Downs-Thanked the participants, especially Sid Munk and Howard Kunz for doing it the right way.
