These notices satisfy two separate but related procedural requirements for activities to be undertaken by
Vernal, Utah.
REQUEST FOR RELEASE OF FUNDS
On or about 28 May 2025, State of Utah, Department of Workforce Services, Housing & Community
Development Division (HCD), will submit a request to the U.S. Department of Housing and Urban
Development for the release of Community Development Block Grant (CDBG) funds under Title I of the
Housing and Community Development Act of 1974, Public Law 93-383, as amended in 42 U.S.C. 5301
et seq., to undertake the project known as Vernal Land Development located at 256 East 600 South,
Vernal, Utah, 84078.
Funding will be used to develop vacant land (5.21 acres) into functional and safe residential building lots
for low-income, single-family housing. Vernal city has already purchased this land. This will be a
multiyear project, continuing into the 2026 funding year. This development will include the following: the
installation of new underground utilities (water, sewer, power, and data), the construction of curbs and
gutters, the resurfacing of existing asphalt, and the construction of a new asphalt road. This project will
be wholly funded through the CDBG program with a total estimated cost of $700,000.
FINDING OF NO SIGNIFICANT IMPACT
HCD has determined that the project will have no significant impact on the environment. Therefore, an
Environmental Impact Statement under the National Environmental Protection Policy Act of 1969 (NEPA)
is not required. Additional project information is contained in the Environmental Review Record (ERR).
This document is available for examination and copying weekdays 10 A.M. to 3 P.M. at the Utah DWS
HCD office, 140 E. 300 S., Salt Lake City, Utah 84111 and the Uintah Basin Association of Governments
office located at 330 East 100 South, Roosevelt, Utah, 84066.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the Utah Department of
Workforce Services, Housing & Community Development Division, Attn: Environmental Review
Specialist, 140 E. 300 S., Salt Lake City, Utah 84111. All comments received by 27 May 2025 will be
considered by the State of Utah prior to authorizing submission of a request for release of funds.
Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
HCD certifies to HUD that Jennifer Domenici, in her official capacity as assistant HCD Director, consents
to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation
to the environmental review process and that these responsibilities have been satisfied. HUD's approval
of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows
HCD to use Program funds.
OBJECTIONS TO HUD RELEASE OF FUNDS
HUD will accept objections to its release of funds and HCD's certification for a period of fifteen days
following the anticipated submission date or its actual receipt of the request (whichever is later) only if
they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of
HCD; (b) HCD has omitted a step or failed to make a decision or finding required by U.S. Department of
Housing and Urban Development regulations at 24 CFR Part 58; (c) the grant recipient or other
participants in the development process have committed funds, incurred costs, or undertaken activities
not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal
agency, acting pursuant to 40 CFR part 1504, has submitted a written finding that the project is
unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted
via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be
addressed to Noemi Ghirghi, CPD Region VIII Director, at CPDRROFDEN@hud.gov. Potential objectors
should contact CPDRROFDEN@hud.gov to verify the actual last day of the objection period.
