NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that on the 13th day of May 2025 at the hour of 6:00 p.m. of said day in the Council Chambers of Heber City, 75 North Main Street Heber City, Utah the Planning Commission will hold and conduct a Public Hearing to consider:
A text amendment proposal to adopt Section 18.08.041 Body Art Facilities and amend sections, 18.28.030 Commercial Zones, 18.44.020 I-1 Industrial Zone, 18.45.020 I-2 Industrial Zone and 18.46.030 Business/Medical Park Zone:
Summary of proposed amendment:
The Body Art Facilities Text Amendment Proposal:
1. 18.08.041 'Body Art Facilities'
a. New section defining 'Body Art Facility', 'Microblading' and 'Permanent
Cosmetics'. The new definitions come from the Utah State Code.
2. 18.28.030 Permitted and Conditional Uses
a. Removes 'Body Art Facilities' from list of prohibited uses. Adds 'Body Art Facilities' as a
permitted use in the C-2, C-3 and C-4 Commercial Zones.
3. 18.44.020 Permitted Primary Uses
a. Adds 'Body Art Facilities' as a permitted use in the I-1 Industrial Zone
4. 18.5.020 Land Use Regulations
a. Adds 'Body Art Facilities' as a permitted use in the I-2 Industrial Zone
5. 18.46.030 Permitted and Conditional Uses
a. Adds 'Body Art Facilities' as a permitted use in the Business/Medical Park (BMP) Zone.
Process: The suggested process leading to a possible adoption includes a public hearing with the
Planning Commission at City Hall. If the Planning Commission recommends approval or approval with
some changes, the draft goes to the City Council for review and a potential eventual adoption.
An MDA for Karl Malone Polaris, located at 900 South and Main Street:
Summary of proposed amendment:
The applicant would like to enter into a Master Development Agreement to expand the existing business and renovation/reconstruction of parking areas at the current location.
A Zoning Amendment for 1874 South Daniels Road to rezone the property from
R-1 (Residential) & I-1 (Industrial) to I-1 (Industrial)
Summary of proposed amendment:
- The property is currently zoned half R-1 Residential and half I-1 Industrial. This
amendment will rezone the full property to I-1 Industrial.
If the Public is unable to attend, the Public Hearing comments can be emailed to PCPublic@heberut.gov. All comments will be read aloud during the open comment portion of the Public Hearing and will be included as part of the permanent public records for this meeting.
