PUBLIC NOTICE TO ISSUE A SECTION 401 WATER QUATLITY CERTIFICATION
PURPOSE OF PUBLIC NOTICE
The purpose of this public notice is to declare the State of Utah's intention to issue a Section 401Water Quality Certification with Conditions under the authority of the Federal Clean Water Act (33U.S.C. § 1341), and consistent with the Utah Water Quality Act, Title 19, Chapter 5, Utah Code and Utah Administrative Code R317-15.

BACKGROUND
Nucor Towers & Structures (Project Proponent) proposes to construct an approximately 70-acre manufacturing facility impacting 4.69 acres of Emergent and Linear wetlands near Brigham City, Utah in Box Elder County. The facility will manufacture overhead powerline support structures. The facility would consist of three (3) buildings, a widening of Watery Lane, new access and entrance/exit roads, stormwater detention basins, a large graveled area, and perimeter fencing. The facility will provide materials to support the construction of new electric transmission system infrastructure for the intermountain west region. The Project Proponent identified the future need for transmission capacity as the primary purpose and need of the project. The Project Proponent indicated that the Federal Energy Regulatory Commission (FERC) predicts a 4.7% increase in demand for electricity over the next 5 years largely driven by the construction of new data centers and renewable energy development. This increase will require a corresponding increase in the transmission capacity of the regional power grid system. The Project Proponent proposes to construct an approximately 70-acre manufacturing facility that will manufacture new structures for overhead electric lines to accommodate this growing need. The Project Proponent plans to purchase credits from the Machine Lake Mitigation Bank to serve as compensatory mitigation for the impacts from the project
