PAROWAN CITY
NOTICE OF DEMAND OF CLAIM TO CEMETERY LOTS
Pursuant to Utah Code §8-5-6, Parowan City has adopted Resolution 2025-02 which allows Parowan City to initiate the process of reclaiming unused cemetery lots from the 1800's in the Parowan City Cemetery. The process is as follows:
1. Initiation of Reclamation Process
The City hereby authorizes the initiation of the process outlined in Utah Code 8-5-6 to reclaim cemetery lots that have been unused for more than 60 years and meet the statutory conditions for reclamation.
2. Notice to Lot Owners or Heirs
a. The City has identified cemetery lots subject to reclamation based on historical records and physical inspection.
b. The City is issuing a formal Notice of Demand to the last known owners or their heirs, requiring them to file a written notice of claim or interest within 30 days, including recorded evidence of ownership; or
c. Such notice shall be served in accordance with the Utah Rules of Civil Procedure.
3. List of Unused Cemetery Lots
The following cemetery lots have been identified as unused for over 60 years and subject to reclamation under this resolution:
o Owned by John Davenport - Block 04-Lot 03 Graves 4 and 5
o Owned by Edward Anderson - Block 04-Lot 04, Graves 1, 2, 3, 4, 5 and 6 only 5 graves available due to space in cemetery
o Owned by Enoch Wardell - Block 04-Lot 05 Graves 2,3,4,5 and 6
o Owned by John M Mitchell - Block 04-Lot 06 Graves 1, 2, 3, 4, 5 and 6
4. Further Action
a. If no valid claim is received within 30 days after the last date of service or publication of the municipal council's resolution, the City may proceed with reclaiming the lot in accordance with state law.
b. Reclaimed lots may be reallocated for sale or other appropriate use as determined by the City Council.
