CONSENT ITEMS
16. RESOLUTION – Supporting the Lindon Hollow Drainage Basin Project
RECOMMENDATION: The City Manager recommends the City Council, by resolution, support the Lindon Hollow Drainage Basin Project.
BACKGROUND: An historical drainage known as the Lindon Hollow Ditch crosses the northern portion of the Anderson-Geneva property in Vineyard. The ditch has served as a drainage for several communities for many decades. Lindon and Orem are working together to purchase the property to maintain the drainage and to construct an urban trail through this area. There is a large thirteen-acre wetland area that will serve as both a natural wildlife habitat and pretreatment area for storm water along the ditch. Lindon is applying for a Lee Ray McCallister Grant to fund the purchase and development of the Lindon Hollow Drainage and trail. This resolution expresses Orem’s support for the submission of the application.
17. RESOLUTION - Interlocal Cooperation Agreement - Phase II Storm Water Discharge Permit
RECOMMENDATION: The Director of Public Works recommends the City Council, by resolution, approve the Interlocal Storm Water Agreement with the Utah County Storm Water Coalition.
BACKGROUND: The City of Orem is a member of the Utah County Storm Water Coalition. The Coalition is administered by Utah County and is comprised of Utah County cities from Payson to Lehi.
The Storm Water Coalition desires to begin working on the educational needs of the various cities in order to meet the public education requirements of the Phase II Storm Water regulations. These public education programs will include newspaper articles, pamphlets/brochures, television spots, videos, classroom materials, etc.
This agreement commits the City to pay Utah County a sum of $9,865 annually. This is Orem’s share of a $50,000 annual budget to develop and supply the cities with the various public education materials, which they can distribute to the residents and use at various City events and other public educational opportunities.

6:15 PM PUBLIC HEARING – Lott Family Farm PRD
18. ORDINANCE – Amending Section 22-5-3(A) of the Orem City Code and the Zoning Map of Orem, Utah, by Rezoning Property Located Generally at 1885 North 400 West from R8 to PRD
REQUEST: The applicant is requesting the City Council, by ordinance, rezone 6.06 acres located generally at 1885 North 400 West from R8 to PRD.
POTENTIALLY AFFECTED AREA: Northridge Neighborhood
BACKGROUND: The purpose of the PRD ordinance is to create diverse and quality housing in the City of Orem.
The applicant proposes the City rezone 6.06 acres from the current R8 zone to the PRD zone. The concept plan for the acreage shows construction of seventeen twin-home buildings for a total of thirty-four units. The Da Vinci Place development is the nearest PRD zone, which is located 1.5 miles to the southeast. In determining traffic numbers, this PRD and a single- family development would produce about the same number of vehicle trips per day. PRDs produce fewer trips per unit; however, there would be more units. Using accepted numbers, a single-family development (4 units/acre) at this location would produce approximately 339 trips per day. A PRD development will generate an average of 340 trips per day.
PRD Development Standards
• Density – The base density of the PRD zone at this location is eight units per acre. The applicant is proposing 5.6 units per acre.
• Height – The maximum height in the PRD zone is twenty-seven feet. The applicant proposes a height of twenty-four feet configured as a single-story twin-home unit. The adjacent zone (R8) has a maximum height of thirty-five feet.
• Area – The PRD zone requires a minimum of 1.5 acres and the applicant is proposing a PRD with over six acres.
• Fencing – A six-foot high fence is required along all exterior property lines with exception to those adjacent to a public right-of-way. The applicant has proposed a six-foot high solid fence.
• Landscaping – Fifty percent of the net property (minus public/private roads) shall be permanently landscaped, which is proposed.
• Exterior Finishing Materials – The front elevation of PRD dwellings shall have at least sixty percent of its exterior finishing materials of either brick, stone, cultured stone, stucco, wood, or a combination of these materials. The rear and side elevations shall have at least forty percent of their exterior finishing materials of either brick, stone, cultured stone, stucco, or wood. The proposed elevations are brick and stucco.
Advantages
• The Planning Commission recommends approval
• It provides additional housing options to the City
• This option allows citizens who choose to not have a yard to have another housing option in the same part of town
• Uniform landscaping and maintenance
• Past experience has shown PRDs to be quiet neighbors and supported by the surrounding neighbors
• Housing provided for “empty-nesters” or retirees with main floor living, which is currently a market need in the city
• Maximum structure height of twenty-seven feet as opposed to thirty-five feet for current zoning
Disadvantages
• Many of the neighbors desire this property to be single-family homes to boost the child and youth populations. Many of the neighbors want families with children that their children can play with. PRDs tend to attract empty nesters or retired citizens.
19. RESOLUTION - Conditional Use Permit – Burton Guest House - 1343 South 1100 East
REQUEST: Mitchell Burton Construction requests the City Council, by resolution, approve a conditional use permit to construct a guest house in the PD 18 zone. The Planning Commission recommends approval with no conditions.
POTENTIALLY AFFECTED AREA: Hillcrest Neighborhood
BACKGROUND: Section 22-11-30(K) of the Orem City Code allows guest houses in the PD 18 zone (The Berkshires) to be approved through a conditional use permit.
Guest houses in the PD-18 zone must meet the following requirements:
• Have the same architectural design and materials as the main residential dwelling
• Be no larger than twenty-five percent of the above grade finished floor area of the primary dwelling nor larger than 4,000 square feet
• May not be rented or sold separately from the main dwelling
• Approved with a conditional use permit
The proposed guest house meets the above requirements as it will be similar to the primary dwelling. The square footage of the guest house is 1,197 with a footprint of 1,240 square feet. The proposed guest house is thirteen percent of the finished floor area of the main dwelling.
20. RESOLUTION - Interlocal Agreement - Lindon City Fire/EMS/Dispatch Services
RECOMMENDATION: The Director of Public Safety recommends that the City Council, by resolution, authorize the Mayor to sign the Interlocal agreement with Lindon City for Fire, Emergency Medical, and Dispatch services.
POTENTIALLY AFFECTED AREA: Citywide
BACKGROUND: Lindon City officials have asked Orem to provide Fire, Emergency Medical, and Dispatch services to their community. The agreement provides for how the services will be delivered, the amount Lindon will pay Orem, and the number of employees Orem will hire. The partnership between Orem and Lindon provides benefits to both communities. Lindon gains full-time fire and emergency medical protection and dispatch services for their police department. Orem receives enhanced coverage for fire and emergency medical services in north Orem.
