Description/Agenda
Town of Goshen Planning & Zoning Goshen Town Hall November 19, 2024 Public Hearing Meeting 7:00 PM A. Pledge of Allegiance- B. Prayer - Jonathan Maclee Jonathan motions to open Public Hearing **moved to Item E first** E. Discuss, consider, and take any necessary action regarding approval of an annexation policy plan- Steven explained the annexation policy plan. Steven mentioned that it was to stir things up, but to solidify a buffer, but no means is it an annex of any land. Spencer from MAG presents himself. He works with entities under 10k residents as a consult to help small communities. He has 15 years of experience in doing so. An annexation policy plan is intent to have a plan. Details were discussed about policy and meaning of the plan, what can and can't be done and an annexation policy plan was discussed as well. This was not saying anyone was being annexed into Goshen. The property owner would have to give consent to want to be annexed into Goshen. Part of the plan is to provide a map the idea of said map is to stop either Santaquin or Genola to annex the land within our boundary of the maps. Steven wants to protect the land that another city could come in and take over, and stops the encroaching. Wade Garner- asked who drew the map and asked why the map takes half the community of Elberta and not follows the natural boundary that has been there which Current Creek is. He states that it is good to maintain natural boundary. Other discussion was had on map, timeline of generation of map etc. Bill Ford mentioned that if this is adopted, the verbiage on the paper is misleading. Jonathan Maclee explained how an annexation works and boundaries. Nan Black mentioned that years ago, this was on their agendas and that the state and county can come in an take over land that isn't in the zones. Wade garner proposed to move the boundary to cut off/end at Currant Creek. Further discussion had on topics included; Elberta and how they may still and already be protected, growth and long term/short term questions and master plan. This is in master plan, and it has already gone through a public hearing and one. Howard Morgan stated that he is bordering Santaquin, and that he would like to bring his property to Goshen. Karen Young had some questions about reading the map as well. Kit Morgan- he stated that he spent 2 terms on P&Z in Payson. State has pushed legislature and also explains how when someone passes away kids take over, they sell possibly to developers. He mentioned that when he was on the committee for Payson; Springlake, Salem all had to sit down and agree on what and who can get to the property with there infrastructures etc. Cheryl mentioned that springlake years ago, payson didn't want them, but now they do. So Springlake will now be their own little town/city. Gregg proposed to motion to recommend, with amendment on boundary lines, to the Town Council. Gentry second that motion, and add to clarify the map all the way around. All in favor. C. Subdivision Ordinance Amendment- Steven presented a rough detail on it and how we have to comply with the state about changes. Bruce-state legislature passed the 12.50.030, completion of allowance of performance guarantee. He does not see this on the new subdivision paper. Mayor answered if it is not in there than we can still fall back on the utah code or state code which then states the same in theirs. Spencer- SB174 is the bill that was passed. Jonathan said yes we can pass this, for the at risk with the recommendation to council that it be added in the subdivision ordinance. ADU- Steven explains how Goshen needs to allow for internal accessory dwelling units. Have only one water hook-up, owner occupied, or live next door/adjacently. Kit Morgan was in the Payson meeting for this agenda topic and asked about a provision to be put in. Further questions were brought to Spencer, differences on internal and accessory dwellings. External dwelling unit is only the one that is not allowed in this ordinance. Explanations were given about examples on what owner adjacent is, with a couple people in town. Lindsay and Bruce asked why you cant have an external dwelling unit but you can have one across the street. Spencer- state forced town to have internal, not external dwelling, those don't have to be in there. It was mentioned by Steven, that he feels Goshen isn't ready to want to a neighbor in the back, ordinance intent is to just allow the minimum expectations, and grandfather those whom are already doing it. Several questions to clarify this topic were discussed, opinions and options included. It was then mentioned that this topic can be further looked at and amended to suit. Gentry would like an external and there are different reasons why, several reasons. Spencer noted after discussion about these three being on the ordinance, that it does cover all three topics, but states 'at this time, the accessory is not allowed by the town of Goshen,' which can be changed in the future if ever they want to. Spencer did state that the external does not have to be put in even, but Goshen does have to have the internal dwelling done. Bruce added that we need to add size, property, height, set backs, etc with it in detail. Upon very in depth questions and concerns, Gregg motioned to discuss externals for future, but motions to recommend a 'yes' for internal and adjacent buildings, this leaving the discussion open for external, after discussion of the definition as said above, specifics of external-external is still being defined, so not approved as of yet. Other questions were asked about already done rentals are affected. It was noted that they would have to register possibly and make everything in alignment with regulations. E. Adjournment - Gregg motions, Bruce seconds, all in favor.
