Concerned Citizen: Kevin Butler was contacted by a citizen regarding a tree that is on city property (190 East 200 South) and it has buckled the sidewalk. He thinks it is technically on city property and is taken care of by the city... The tree has got to go. It will need to be by someone with large equipment. It is a hazard to the public. Dave McKee says it is on his list to take care of.
GARY BENNET-Business License
Gary wants to resell tools to the oil and gas fields. There won't be any people coming and going from his home. He will deliver the tools.
Motion to approve his business license made by John Hughes, second by Carolyn Carrasco. Yea: Doug Stilson, Carolyn Carrasco, Leland Sasser, Bill Dellos, Kris Bell, Kari Alton, John Hughes, Kevin Butler. Nay: None
STEPHANIE BROTHERSON - BARNDIMINIUM
Seth reports that Stephanie and Mark Brotherson are having problems with their privacy when there events at the Barndiminium. Steve Durrant also made a complaint to John. When you want to do things on your own property. There should be a privacy fence. The committee talked about a privacy fence when the Barndiminium came in for building permits. The Air BnB codes include no loud noise after certain times and the lights can't shine onto the neighbor's property to disrupt them. All we're asking for is a little bit of courtesy. Seth is going to tell them they need to put up a privacy fence. They also need to adhere to the noise codes. Kevin knows them and will have a conversation with them about it. Seth is also going to send an email to the owners.
DAVE McKEE:
Dave recently started working for the City on maintenance. He's been working to clear up the frontage of some properties. He thinks we need to work with the citizens about the frontage area that is technically city property. They don't do it because it's 'not theirs'. As a city we can't tell them that they have to maintain that area. But the city workers can mow them is it's needs to be done. The power company and Emery Telcom will be the only ones that will need to use that 10 feet. Chad Larsen is working on the RV park and wants to landscape all the way to the sidewalk. If the citizens want to landscape, it's ok for them do it.
ZONING ADMINISTER REPORT-SETH MANNING:
Chad Larsen applied for a business license in July, it was granted with the stipulation that he bring in his State license number. Seth has talked to DOPL and his license is waiting to go through but they have a backlog. He is good to go as far as they are concerned.
Dionne Lofley had fence questions and Seth went and looked at it and gave his okay.
Food Ranch is still not compliant. They still have the walls under the eaves of the overhang. Seth could send another letter or we hold back and leave it until his business license comes due in March and withhold it until he finishes deconstructing and pays the fine. This will make it so we don't spend any more money on attorneys.
Seth asked who is in charge of the speed limit signs. The one on north main is held to the pole with baling wire. Doug reported that UDOT told him they over a month ago that they were going to start putting in the new signs and updating old signs within a month. Doug gave Kevin the cell # and Kevin will call them also.
The code for cemetery vaults needs to be rewritten to include ABS vaults in the code book. This has already been approved. Seth would like City Code 8-2-3-F to be worded as 'It shall be unlawful for the remains of a human body, except for cremains, to be buried in the cemetery, unless the casket shall be placed in a concrete vault with a concrete lid, or steel vault with a steel lid, or an ABS vault and an ABS lid. If it appears that there is insufficient room in a grave's boundary for a vault, the sexton may authorize burial without a vault. All lots marked or sold hereafter shall be of sufficient size to accept a vault.'
We need a City noise ordinance. He got a call the other day about Chad Larsen going to work at 5 am on the Bobcat, on the property for the RV park. Doug brought this up to Seth because his property is next to the lot. He thinks there should be a discussion because he knows there have been other people concerned about noise in the RV parks, etc. The noise ordinance reverts back to the state ordinance. Utah's ordinance says 7 am to 10 pm. We need to make an ordinance so that we can cite the law. We need to look into state guidelines and other communities. This will be revisited in future meetings.
Bill is concerned about the carport that Kelly Alton built. He did it when he was told not to. Do we want to bother his widow about it? Seth will look into it and report back.
CITY COUNCIL REPORT- KEVIN BUTLER: He'd like to mention that the digital stop signs with speed detecting monitors coming in from Food Ranch and Joe's Valley.
The City is planning to extend the cemetery.
Motion to adjourn the meeting by Bill Dellos and seconded by Carolyn Carrasco. Yea: : Doug Stilson, Carolyn Carrasco, Leland Sasser, Bill Dellos, Kris Bell, Kari Alton, John Hughes, Mike Jewkes, Kevin Butler. Nay: none.
Meeting adjourned at 8:27 pm.
