The bills/payroll/reimbursement invoices dated November 15, 2024- December 11,2024 were given to the council before the meeting for review. Councilman Dallin wondered about the tree trimming being charged to the Roads account instead of electrical. RD- Public works, replied that most of the trees trimmed were hanging over road areas and the town hall. It is procedure to call Pennys tree services when trees needing to be trimmed are near electical lines. As some of the trees were near electrical lines it was decided to split the cost between roads and the electrical department. Council would like Public works to contact them for consent before purchases or repairs are done. The furnace at the town hall needed a new circuit board and councilman Stephenson was not made aware of the need or cost for the repair until the bills were posted. Tamara Dallin motioned to pay bills/payroll/reimbursement invoices November 15, 2024- December 11,2024 LaRee Stephenson seconded. Roll was called; , LaRee Stephenson- yes, Tamara Dallin-yes, Phil Whatcott- yes, Mayor Fox-yes 4. Petitions, Remonstrance and Communications 5. Planning and Land Use- Ted Bennet No new permit requests. The new subdivision ordinance was discussed at the planning meeting. The planning and Zoning committee did not have any problems or issues with the new code. Daniel Jensen with Sunrise Engineering was at the town board meeting to discuss any issues and clarifications. In 2023, Legislative session Senate Bill 174 enacted codes 10-9a-604.1,10-9a-604.2,10-9a-604.9. In 2024 Legislative Session House Bill 476 amended codes; 10-9a604.2, 10-9a-604.5, 10-9a-80 to simplify the subdivision and building approval process. The state was concerned about how the process was being handled from the standpoint of the towns and the developers. The States goal was to make the subdivision process administrative in nature and stay outside the council and mayor. Town councils will be left to make legislative decisions, general plan, annexations, code, amendments, items regarding discretion that is in the best interest of the city. A subdivision is administrative in nature. The new code changes things in that with subdivision and new buildings the developer or contractor will go before the planning committee with a complete submittal. The town will then have 40 days to review and approve. The town clerk will then sign off on the final plat. If residents have concerns about development those concerns need to be addressed with the planning and zoning committee, according to the general plan and zoning code. Subdivision in Holden will go through the simple process at present because Holden has kept the town's municipal boundaries tight. The town does not have a lot of undeveloped land. Smaller situations/ Simple process means that any lot that is being created is along an existing street, has connections to required utilities. They will still need to meet zoning code standards, frontage, lot size, and will need to be recorded with the county. Subdivision Definition- Any land that is divided, re-subdivided or proposed to be divided into two or more lots, parcels, sites, units, plots or other division of land for the purpose, whether immediate or future, for offer, sale, lease or development, either on the installment plan or upon any and all other plans, terms and conditions. The process Holden has been following will remain the same. The updated code was a requirement from the State and funded through the State. Please Note, the town is NOT putting in a subdivision, nor has plans to do so in the future. Phil Whatcott motioned to adopt the new subdivision code Title 13, ordinance 2024-4, laRee Stephenson seconded. Roll was called, LaRee Stephenson- yes, Tamara Dallin-yes, Phil Whatcott- yes, Mayor Fox-yes 6. Report of Officers a. - Roads & Landfill *Backhoe update- The backhoe is still at Mason Machinery. Mason found that it wouldn't start efficiently and discovered that the fuel injector pump was bad and needed to be replaced. They are waiting on the part and hope to have it fixed and the backhoe returned to the town by the end of December. *Landfill- The permit is still under review waiting on the review of higher officials at the state level. The landfill gate lock has been re-keyed. Penney's tree service asked about the possibility of obtaining a key for the purpose of dumping the trimmings they obtain through service to the town residents. It was decided that according to the new resolution they could NOT have a key. If the property owner they are trimming trees for would like to check out a key and escort Penny's to the landfill that would be ok. The resolution states that only those with a town utility garbage fee may have access to use the landfill. Public works has the snow plow ready to go. All that is needed now is snow. b. Parks, Recreation and CERT The cabinet to house the DUP records has been delivered and set up. The DUP have raised half the funds ($88.00) toward the purchase of the cabinet. It was noted that the vacuum at the town hall is not working very well, could a new vacuum be purchased? C..David Wood - Electric Not in attendance d.Phil Whatcott -Fire Department The fire department's budget is getting tight. The fire chief is trying to get more funding for the fire department so that they have the means to obtain the needed equipment and gear. The fire department is in need of new pagers. The county has gone to a phone based paging system, our small department are not able to receive alerts. They would like to purchase 5 new pagers costing approximately $1,536.00. The fire department has not yet received a key to the landfill. Councilman Dallin will check with the Post office clerk to get a key to them. Water There will be a pre construction meeting to meet with the drilling contractor on December 19th at 10:00am at the Town Hall in Holden. The USRDA requirements need to be met and have the attorneys review it. e. Mayor Darren Fox 7. New Business *Subdivision Ordinance- See under Planning and land use. * Public works would like to re-do the town hall kitchen floor. Rod has two boxes of flooring that he will donate to the town and the town would need to purchase one or two more boxes. The flooring would be a snap together vinyl type flooring. Public works would also like to redo the flooring in the lobby at the post office. They estimated cost would be approximately $70 for the kitchen flooring and $400 for the post office flooring. Councilman Stephenson will look at the kitchen floor and the mayor will decide on the post office flooring. No approval on the flooring projects were made. 8. Outstanding Business 9.
