Description/Agenda
Woodruff Town Board Meeting October 15, 2024 Minutes from the Woodruff Town Board meeting held October 15, 2024 at the Town Hall at 5:00 p.m. Those present: Council Members: Joel Marler (801) 567-1194, joelmarler@me.com Monika Schulthess (435) 881-9098, m.schulthess@hotmail.com Seiko Webb (801) 824-1495, seiko.webb@gmail.com Raymond Frandsen (801) 448-1545 Clerk: Allie Deru (435) 793-4201, woodruff@allwest.net Ocie Frazier Wally Schulthess The meeting was called to order by Monika Schulthess. Mayor Sabey was unable to make it to the meeting. The meeting was opened up to Ocie Frazier. Ocie Frazier explained to the town board that when the town's first well was drilled, it was done on his parent's land around 1955. There was a pipeline that ran to a pump from the Eastman spring (done around 1934), by his mom's house that was used for town water. He explained that it was discussed that if the town was allowed to drill a new town well on their land, the town would give the Frazier's a water right for the house and a stock water right. Ocie Frazier says that the stock water right has never been transferred and wondered if he could work something out with the town to now get that transferred. Wally Schulthess stated that the water rights are listed on the state website specifically from the Eastman spring which is where the original pipeline came from. Since then, they have transferred those rights to both wells, the one on Frazier's and the one in town. He says there is not a problem with Wooduff having enough water rights and if Woodruff would like to expand and grow they would be able to. Ocie Frazier would use the water right mainly for stock water. It is not a large amount of water. Ocie said that his mom has a paper that would provide proof that this happened. It was discussed that this topic should already be in the Woodruff records. The town board said that they will look into it and see what they can find. Ocie Frazier also wondered if he would be responsible and liable if someone were to fall in the well at the head house because it is on his property. The town has liability insurance and the town board thinks that an incident should be covered under that. The town board is going to look into that and set up an agreement showing that the Town of Woodruff would be liable for any accidents that happened there and that Ocie Frazier would not be responsible. Seiko Webb attended the BRAG meeting about the Hazard Mitigation Plan. If the town participates in this plan, we can receive federal money if a catastrophe were to happen in town. A survey was filled out together as a town board for this during the meeting. The Woodruff Irrigation Company is working with the town on this. They are working on their own plan but want to be in communication with the town on this so that a good plan can be made. It is dealing with catastrophes that could potentially happen in Woodruff. The irrigation company's main concern would be floods or high water. The town would be concerned with any natural disaster that could happen in town. BRAG is available to help the town with getting this emergency plan together. This will be a matter that is continually worked on in the future. The county is ultimately the ones who are going to be in charge and already have plans in place for a disaster plan. The town board discussed what the town could do in case there was an emergency. All of this is on the future agenda on getting an emergency plan in place to know what will happen in those situations. The town board recognizes that being organized with a plan will help reduce chaos in a time of emergency. Chris Schulthess shut off and locked the water meter that is at Herrera's. The attorney has emailed and sent a letter to the Herrera's but hasn't heard anything from them yet. Monika Schulthess is going to follow up with the attorney. A question was brought up wondering if the town board would be able to come to a partial agreement. The board is hesitant to try to compromise on an agreement with the Herrera's because they feel that it could open up a can of worms with both past and present parties that have previously installed water meters. Mayor Sabey attended the meeting concerning the tourism grant the the town applied for. He said that he is hopeful we will receive some money but probably not the full amount that we applied for. The board might have to pick highest priorities on what needs fixed at the town hall. The roof and the sidewalks are the main concern right now. Fixing the town sidewalks is something that the board feels needs to be addressed in the near future. The town board is concerned with the sidewalk in front of Jared Huffaker's house. It is very uneven which is a problem for people using it and to plow the snow in the winter. Seiko Webb made a motion to approve September minutes. Raymond Frandsen seconded the motion. Motion carried unanimously. Joel Marler made a motion to approve the October bills. Raymond Frandsen seconded the motion. Motion carried unanimously. The copper and lead survey was sent out to 13 houses that had unknown pipes in their houses. Three have been returned. This copper and lead survey documentation will be submitted to the State and they said once we receive more information about what kind of pipes are in these homes then it can be added later. Meeting was adjourned at 5:40 p.m. _______________________________________ Clerk
