Agenda Item #4 Discussion of tiny homes and other issues discussed briefly in last month's meeting
Commissioner Moosman recounted that no signage or advertising was allowed per conditional use/home business business license for Johnson. Chairperson Cha mentioned Johnson's fence is too close to the corner, people can't see around the corner and has an 8 to 10' fence around residence which is not to allowed per Wellington City ordinance, Commissioner Moosman agreed.
Commissioner Moosman mentioned the Tiny Housing subject. Wellington City has no ordinances thus far for this type of residence and acknowledges a need for this kind of housing. Commissioner McKinnon and Patterson both mentioned that they should be permanent structures with concrete pads and insulated skirting or similar materials around the bottom. Commissioner Moosman acknowledged they are not meant to be moved around like an RV.
Commissioner Patterson acknowledges the need for ordinances for tiny home communities, to keep them out of the main residential areas and to encourage developers to build this type of community. Commissioner Moosman brought up the need to define clearly what materials can be used for construction, asking the question about shipping containers as potential materials, bringing up the fact that people are bringing in these shipping containers as buildings/storage sheds/barns when Wellington City has no specific ordinance for these. Commissioner Moosman strongly suggests that these tiny home communities be managed by an HOA (Homeowner's Association) with minimum standards approved by the Planning and Zoning Commission. Commissioner McKinnon noticed that, in a handout each commissioner received, Utah acknowledged that the state was slow to accommodate codes for tiny homes and their communities.
Commissioner Moosman acknowledged that the sheds across from city hall were not permissible and if nothing else needed a business license.
Chairperson Cha acknowledged Bernie Morris. Mr. Morris explained about a property he has owned for 40 years that is now 'condemned' because of an ordinance which went into effect after the purchase of this property. The property has adequate frontage for in/out access. Wants to sell the property but found out by the title company, researcher Robby Edisle, that City Ordinance states in that area, a lot has to be at least 1 acre to build on. Mr. Morris believes he has a case to be grandfathered into the replaced ordinance of 1/2 acre for a building lot which was supposedly in force when he bought the property. In consideration for being permitted to build on this .64 acre property, Mr. Morris suggests giving up larger animal rights. The property in the area is currently zoned R1-43. Mr. Morris also states that he has been paying taxes on the lot as if it had worth since he has owned the property. If it isn't a legitimate building lot he is protesting the taxes he has been paying. He has another piece of property that is deemed worthless by the county because of elevation and the taxes on it are negligible. Commissioner Moosman states research needs to be done as to when the ordinance was changed and that area was rezoned to 1 acre building lots.
Motion: No motion made.
Agenda Item #5 City Council Follow Up.
