PANGUITCH CITY ORDINANCE 2024-3
A TEMPORARY LAND USE REGULATION ON SHORT TERM RENTAL PERMITS IN RESIDENTIAL AND AGRICULTURAL ZONES
WHEREAS, Panguitch City currently permits Short Term Rental uses in certain districts and;
WHEREAS, Utah Code Ann. ยง10-9a-504 states '(a) municipal legislative body may, without prior consideration of or recommendation from the planning commission, enact an ordinance establishing a temporary land use regulation for any part or all of the area within the municipality if: (I) the legislative body makes a finding of compelling, countervailing public interest and;
WHEREAS, Panguitch City has received and administratively approved new permit applications for Short Term Rental uses in all residential and agriculture zone districts and not affecting commercial zones in the City and;
WHEREAS, Short Term Rental and homes have the potential to negatively impact surrounding residential properties and neighborhoods through noise, traffic, neighborhood character, safety, and other ways;
WHEREAS, the Panguitch City Planning Commission and City Council need time to review and amend, if needed, Short Term Rental regulations prior to approving any new permits for Short Term Rental and Airbnb in residential and agricultural zoning districts.
NOW, THEREFORE, BE IT ORDAINED by the City Council that it does hereby approve a temporary land use regulation prohibiting Short Term Rental and applications in residential and agricultural zoning districts for a period not to exceed 6 months from the enactment of this ordinance.
