He thought he had brought a map showing where he split the property but realized he didn't have the map but he could present that later if necessary. He pointed out that the property isn't square so they are going to quitclaim about 50 ft. to make it square; however, all the property is in his name he is just quitclaiming one piece. Adam Richins, of the County, has approved everything. The water and power have been checked out. The water has been transferred to Kaige. Kaige is hoping the Town can just sign off on this. Kendell motioned, seconded by Peggy, to recommend that the Oak City Town Council approve the Kaige Western Application. Roll Call Vote: Dylan-Aye. Peggy-Aye. Kendall-Aye. Collin-Absent. Where the Oak City Town Council had previously authorized that the Mayor could approve applications if they met all the criteria, the Mayor signed off on the Application. E. Discuss and Possibly Approve Updated Subdivision Ordinance for Town General Plan-Daniel Jensen, Sunrise Engineering. Daniel gave the Commission the back story of how this all came about. In 2023, the legislature made some major changes in the subdivision rules but then they just made more changes. Where this could cause a hardship for small towns, such as Oak City, to implement all the changes, they authorized a bunch of funding to go to Work Force Services to distribute to all small towns that need help to create an updated ordinance. Shim called Daniel and requested his help since he was listed with the State. This has allowed Daniel to help the Town with updating its subdivision ordinance. Some of the changes are: Subdivision applications go through the Planning Commission, there will be no Town Council involvement. There would not be so many arbitrary rules. The State has set up an entire process for the approval of a subdivision and the Town would need to follow this process. Before a subdivision goes before the planning commission, the developer has to submit the entire application and all paperwork and it can't be changed unless the developer goes through the entire process again. There is a time frame that must be followed. If an application was denied, the Planning Commission would need to site the Town Code that caused the denial. Attorney Greathouse, made several comments and asked several questions during this presentation. The Mayor understood that if the Town doesn't have the staff to fulfil the process, the 6 County Association would help with an administrator. The Commission members and Mayor will read through the sample Ordinance that Daniel created and look for any issues they have with it. One issue that Dylan had was that there where places that might need to have definitions. Daniel will add definitions as needed. Daniel recommended quickly getting a road map set up so it can be in place before anyone applies for a subdivision. He went over some of the time frames and issues addressed in the Ordinance. For a small Town like Oak City, there is a reference to a simple lot subdivision which is a lot less complicated. This is basically a metes and bounds subdivision. Daniel went through this a little. The Mayor had looked through the proposed Ordinance but the Commission members had not so the Commission members will take time to go through it in depth and be prepared to go over the Ordinance next month. Daniel encouraged them to call or e-mail him with any questions or concerns so by next month, the Ordinance would be about ready to go with the option to adopt it if they feel prepared to do so. Daniel mentioned that the subdivision application should require a title report which could ensure that property lines do not overlap or underlap and if they do, the developer would have to address these. The Mayor pointed out that the Town has many areas where there are underlaps and overlaps. Daniel thought that where there are so many, there might be a grant available for the Town to hire a surveyor to do the entire town or, at least, the needed areas so these could be addressed all at one. Daniel will look to see if there are any grants available for this. Need to try to have the Ordinance in force by December 21, 2024 or close to that. F. Miscellaneous. There were no miscellaneous items. G. Adjournment. Commission Member Dylan Finlinson adjourned the meeting at 8:40 p.m. Submitted by: ____________________________ Approved By, ____________________________________ Karen K.
