Amalga Planning and Zoning Minutes September 4, 2024 7:00 PM 6590 N 2400 W Amalga, Utah Visitors: Alan Noble, Sid Munk, Jerry Munk, Marilyn Munk, Gwen Hansen, Mike Bouck, Scott Jenson, Paul Campbell, Dave Hansen, Vic Bingham, DJ Anderson, Sharon Munk, Howard Kunz, Brett Downs, Teena Humpherys, Nikolas Nielson, were others that the recorder didn't pick up. Commission Members: Judy Downs, Acting Chair, April Hansen, Mike Diehl, Kelly Noble, Dave Lee, Secretary/Town Board A Public Hearing was convened to receive input on an Amendment to the Town Code presented by David Wood. This amendment would affect Amalga Town Code 2.99 Minor Subdivision a), and Amalga Subdivision Ordinance, Section 1, l-8, Definitions, Minor Subdivision A. This amendment, if approved, would change the waiting time between building on subdivided lots, from 4 years to 2 years, in the minor subdivision Ordinance. Judy Downs presented the amendment, and explained the current situation. That being that as a Minor Subdivision only 1 lot can be created, and a period of 4 years must pass before another lot can be created without becoming a Major Subdivision. The 4 year waiting time commences with the application for a zoning clearance for a building permit. David Wood explained his reasons for wanting the change. He has created a new lot for his son Aaron, and his granddaughter would like to get a lot and build also. Interest rates could go up or down, and the cost of building materials will probably continue to increase. Waiting only 2 years would possibly help with some of these costs. Alan Noble-Alan thanked those on the Board for serving. He has served and knows it can be difficult. He agreed with the Mayor, and in fact he would go for 1 year. The growth isn't necessarily here now, but it's going to come. We've had this discussion before and changed lot sizes, and the growth has not come. He has several kids and would like to help them at some time if he could. He brought up the Brad Noble lots. They are cheaper than a lot in town, but they still haven't sold. The growth is not coming yet, but it will come. He would support 2 years, or even 1. Michael Bouck-Interest rates go up and down. When he built his home, interest rates were up and they came back down. It's all a matter of perspective. As far as 2 or 4 years, he would like to have some history as to why the 4 years was put in to that, and take that into consideration. Not for or against the amendment. Judy Downs read from the Town Code-'Part of the goals and objectives were to be timed and sequenced in a manner consistent with the capacity of available public services and facilities.' She felt that we are timing this so we know what the town can support. Dave Wood said we don't have a water issue now. Not as far as we know. Across the river Visionary is building lots of homes and that is pretty close to our water. Gwen Hansen-Question about how the subdivision system worked. Judy explained. Sid Munk-Question about parcels of ground and subdivisions. Several people talking. A single parcel is what this rule applies to. If you have several parcels of ground, you could subdivide and put 1 home on each parcel. From there you would have to wait either 2 or 4 years for the next subdivision. Sid likes the 4 year. It has worked well so far. Scott Jenson-In favor of 2 years or 1. Would make lots more available for family. Also controlled growth would be better to protect our water. Paul Campbell-In favor of 2 years. Would make more lots available for family. Dave Hansen-More than half of the lots would not be sold to family. Most people with property have several parcels. They could put a lot on any of those parcels. The property that was subdivided by Ken Hansen and those lots were sold to out of towners, and only one of the original purchasers stayed. Everyone else moved. Believes more of the lots would be sold to people other than family members. In favor of leaving it at 4 years. There's been years when we have run a little short of water. Schreibers pays for our water system. Vic Bingham-In favor of 2 years. Interest could be an issue. Interest has been higher and lower. DJ Anderson-Believes Amalga is special and the laws we have kept it that way. Favors 4. Jerry Munk-Favors 4. Believes a lot of the lots would not go to family. Sharon Munk-Water issue Howard Kunz-Sewer Planning ahead seemed to come up several times. Minutes of August 7, 2024, read by Mike Diehl. Corrections: 5. 'may possibly be' 6. Sid Munk name correction, also in visitors Motion to Approve with corrections-Kelly Noble Second April Hansen Motion Carried 2. Brad and Katie Wilson came in to clarify the placement of a shed of 120 square feet or smaller. Does not require a zoning clearance. The letter from the town attorney on this was reviewed. 3. Nikolas Nielson applied for a Business License for a mobile diesel repair business. A sign for advertising was discussed. He is not planning on a sign at this point, but will come in for a review before putting a sign up if he decides he wants one. No business to be conducted at his residence. Motion to Approve-April Hansen Second-Mike Diehl Motion Carried 4. Zoning Clearance Application presented by Aaron Wood for a home at 8536 N 2400 W. Setbacks were reviewed. Motion to Approve-Kelly Noble Second-Judy Downs Motion Carried Letters sent out to those that might be in violation of Town Code were reviewed. No vote was taken on the Public Hearing from this evening. It was decided that more thought needed to be given, and the item had not been placed on the agenda.
