EAGLE MOUNTAIN CITY COUNCIL
NOTICE OF PUBLIC HEARINGS
The Eagle Mountain City Council will hold public hearings on September 3, 2024, at 7:00 PM or as soon thereafter as business allows, in the Eagle Mountain City Council Chambers, 1650 E Stagecoach Run, Eagle Mountain, Utah 84005. The City Council will receive public comments concerning the following items:
- Enyo Rezone: A proposal to enact an ordinance rezoning tax parcel 59:068:0004 comprising 160 acres of land from the Airpark Zone to the Agricultural (Ag) Zone (owned by Land Mountain Land Co. LLC); the parcel is located at the south/southwest end of the city at the SE intersection of N. 500 east and E. 100 North Streets. EMC Staff Point of Contact: Robert Hobbs, rhobbs@emcity.org.
- The Ranches and Eagle Mountain Properties Rezone, Future Land Use Map Amendments, and Rezones of various undeveloped properties within expired Master Development Areas: The parcels are generally located in the Eagle Mountain Properties master development plan areas of the City. - Berry Property General Plan Amendment and Rezone: A proposed General Plan amendment and rezone to tax parcel 59:019:0015 changing the Future Land Use Map from Agricultural/Rural Density Two to Foothill Residential and the zone from Agriculture to Foothill Residential. - Eagle Mountain Municipal Code Amendments:
o EMMC 17.25.050, 17.35.050, 17.37.050 Generally Applicable Provisions: The proposed code amendments relate to setbacks near a natural wash. The phrase 'significant setbacks' occurs in three places in the current city code, and staff recommends changing this to a 50' setback from the top of the wash to be consistent and measurable. This aligns with a recommendation from JWO Engineering in their 2022 Tickville Wash report. EMC Staff Point of Contact: Todd Black, tblack@emcity.org.
o EMMC 17.20 Agriculture Zone, 17.38 Commercial Storage Zone, and 17.40 Industrial Zone: A proposal to amend EMMC to provide an introductory subsection for each chapter, reformatting the land use table for each zone including eliminating conditional use permit requirements, and making minor revisions to 17.40.070 to withdraw a moving vehicle quantity cap, and to 17.40.100 to remove references to previous zoning district equivalents. o EMMC 17.60 Landscaping, Buffering, Fencing, and Transitioning: A proposal to add EMMC Section 17.60.155 to specify that a lot size and zoning mixture is required for subdivisions being proposed for development in a Neighborhood Residential 1 General Plan Future Land Use setting. The proposed language states that no more than one-third of the total building lots in any subdivision that lies within an NR1 Future Land Use Category area shall be comprised of lots zoned R3, and no more than one-half of the remaining building lots in that same subdivision shall be designated R2. o EMMC 16.35.090 Privacy Fencing, 17.10 Definitions, 17.60.120 General Fencing Provisions, and 17.60.130 Chain Link Fencing: The amendment adds a definition for retaining walls, and clarifies allowed amounts of wire fencing, screening, and screening replacement requirements along certain roadways, and retaining wall construction and allowed locations.
