RESOLUTION NO. 8 01 2024
A RESOLUTION DEMANDING THE FILING OF NOTICE OF CLAIM REGARDING CERTAIN LOTS WITHIN THE MONROE CITY CEMETERY, AND RELATED MATTERS
WHEREAS, certain lots, sites, or portions of the Monroe City Cemetery, as described below, have been unused and unclaimed for more than 60 years;
WHEREAS, the Utah State Code, Title 8, Chapter 5, provides that the City Council can adopt a resolution demanding that the owner of an unused and unclaimed lot of the cemetery, which has been unused for more than 60 years, file with the city recorder a notice of a claim;
WHEREAS, a copy of the resolution shall be delivered personally to the owner of record or, if the owner cannot be personally served, the resolution shall be published on the Utah Public Notice Website for three weeks with copies mailed to owners' last known addresses, if available;
WHEREAS, if no notice of claim is received within 60 days of personal service, or 30 days after publication of notice where the owner is not known or cannot otherwise be personally served, the owners' rights shall be terminated and such rights shall vest with the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of Monroe City, Utah:
1. The City Council finds that the following cemetery spaces have been unused or unclaimed for 60 or more years:

2. The City Council orders that this resolution and notice should be published for the owners of such lots and spaces as set forth above and by State Code.
3. The City Council orders that, where no notice of claim is filed within the timeframes described above and in the State Code, the rights of owners to unclaimed cemetery lots and spaces shall be terminated.
4. This resolution shall take effect immediately upon passage.
