GREEN RIVER II SOLAR COMMUNITY REINVESTMENT PROJECT AREA (CRA) Notice of Action Taken Regarding Diversion of Property Tax for a Community Reinvestment Project Area AND Execution of Interlocal Agreements between the Emery County Community Reinvestment Agency and: Emery County Emery County School District Emery Water Conservancy District Pursuant to Sections 11-13-219 and 17C-5-205(2) of the Utah Code, notice is hereby given by the public entities listed above that the Emery County Community Reinvestment Agency (the 'Agency') has entered into an Interlocal Cooperation Agreement with Emery County, the Emery County School District, and the Emery Water Conservancy District. The Interlocal Agreements were approved and adopted during open and public meetings by the participating taxing entities in accordance with Utah Code 17C-5-205(1)(a) held on April 19, 2021, October 6, 2021, and August 23, 2021, respectively. The Interlocal Agreements were adopted and approved in accordance with Utah Code 17C-5-205(1)(a) by the Emery County Community Reinvestment Agency on July 30, 2024. The Interlocal Agreement(s) authorize the Agency to receive all or a portion of the taxing entity's tax increment revenues generated within the Green River II Solar Community Reinvestment Area (CRA), to provide funds to the Agency to carry out the Green River II Solar CRA Project Area Plan and Budget. Emery County, the Emery County School District, and the Emery Water Conservancy District have agreed to allow the Agency to collect property Tax Increment for a period of twenty (20) years in accordance with the Green River II Solar Community Reinvestment Area Plan and Budget. The Interlocal Agreement(s) shall become effective at the end of the 30-day notice period required under Utah Code Section 17C-5-205(2)(a) as set forth in Utah Code Section 17C-5-204. Resolution No. 07-30-24b (the 'Resolution') was adopted by the Emery County Community Reinvestment Agency on July 30, 2024, further detailing the process for the Diversion of Property Tax for the Green River II Solar Community Reinvestment Project Area. Copies of the Interlocal Agreement(s) and Resolution noted above, along with the Project Area Plan and Budget, are available for public inspection at the Agency's office located at 75 E Main Street, Castle Dale, Utah 84513, during regular business hours, Monday through Friday. Additionally, copies of the Interlocal Agreement are available for public inspection and copying at the offices of the respective taxing entities during regular business hours, Monday through Friday. For a period of thirty (30) days after the effective date of the Interlocal Agreements, any person in interest may contest the Interlocal Agreement(s) or the procedure used to adopt it if the Interlocal Agreement(s) or the procedures fail to comply with any applicable statutory requirements. After expiration of that 30-day period, no person may contest: (i) the Interlocal Agreement(s); (ii) the distribution of tax increment to the Agency under the Interlocal Agreement(s); or (iii) the Agency's use of project area funds under the Interlocal Agreement(s).
