Minutes of Regular Town Board Meeting Held May 16, 2024 The meeting was held at the Oak City Town Hall beginning at 7:30 p.m. in the Conference Room. The following were in attendance: TOWN OFFICIALS Mayor Shim Callister Council Member Dave Steele Council Member Tom Nielson Council Member Copeland Anderson Town Clerk Karen K. Lovell Town Recorder Angie Dewsnup OTHERS Carol Nielson Valerie Hathaway Tyson Hathaway Sarah Chapman Marianne Banks Council Member Jared Rawlinson was not in attendance. The following agenda items were considered: A. Invocation. The invocation was given by Copeland. B. Adopt Agenda. Dave moved, seconded by Tom, to adopt the Agenda as written. Roll Call Vote: Mayor Callister-Aye. Dave-Aye. Tom-Aye. Jared-Absent. Copeland-Aye. C. Adopt Minutes of Town Board Regular Meeting held May 16. 2024. Tom moved, seconded by Copeland, to adopt the Minutes as written. Roll Call Vote: Mayor Callister-Aye. Dave-Aye. Tom-Aye. Jared-Absent. Copeland-Aye. D. Discuss Possible Location of Pickleball Courts-Valerie Hathaway. They have started fund raising. Have a possible $20,000 so far. This includes money from a new grant that just became available. Believe the grant is a matching grant. The Mayor has told the ladies that the Town would pay for the benches and the lighting so that should add up to about $3,000 which is all that the grant might be for. Tom reported that they have been looking at the elevation and other factors and decided to try to put it on the North East corner of the Park. Will need a 2 ft. foot wall poured. The Town can do some work but the professionals need to do most or they won't insure it. They will give a bid and then will see if going to use them. Jacob Cooper is the representative of the Company but Valerie couldn't remember the name of the company. Valerie suggested moving the sod from the Park to the Cemetery so the new sprinkling system needs to be put in at the Cemetery before digging out the sod. There is another Grant available through Healthy Living Utah that the Town might qualify for. There are certain things that need to be done to qualify for it. Valerie will type up the grant application and bring it to the Mayor for his signature. The ladies are hoping to get new lines painted for a pickleball court and could cover, the lines only, with a clear coat of polyurethane for now or might just put down the tape. They are hoping this can be done by Fall. The Mayor thought the Town could do a net also. The Committee has been going around fund raising and some of those donating want receipts. How can this be done? Will have Angie help with this. E. Discuss Discounting Utility Bills for Deployed Military Members-Sarah Chapman. She pointed out that when someone is deployed, they get a certain amount base pay and it is never enough. No one is deployed in Oak City right now that she knows of but her husband, Kendall, is very likely to be soon. Could Oak City start looking at something now? Tom pointed out the Town has widows and social security recipients that don't make even as much as a National Guard member and they don't get any kind of utility discount. Need to make sure not helping one group over another. Sarah pointed out that parties aren't deployed for very long so the discount would not need to be in place for very long. Dave recommended looking at what other municipalities are doing and discuss this again at the June Town Board Meeting. F. Discuss the Board of Adjustment Recommendation for a Variance on Setback for Tyson Hathaway's West Property Line at Approximately 85 South 100 West -Tyson Hathaway. Tyson presented the paperwork showing his Plan for a proposed greenhouse. He went through it with the Council. The newest drawings are not a lot different than his first drawing he presented to the Board of Adjustments some time ago. He pointed out that where his property is located on a corner lot, it makes it so he has to have two 25 ft. frontages. He originally asked to put his structure 4 ft. from the property line. The first page of his drawings shows what the Board of Adjustments had decided to recommend to the Town Council. Tyson wondered if the Council would be willing to adopt the Board of Adjustments' recommendation which would allow him to build 13 ft. back from his property line instead of 25 ft.? Tom stated he would rather see Tyson place the greenhouse 25 ft. back on the frontage and go with less feet in the back on the East end. This might mean the greenhouse would have to be 4 ft. shorter. This would keep the greenhouse back from the road. Tyson pointed out why he did it his way, it would allow him to have some room between the fence and the wall so vans and movers would have more room to come in and out and would keep it from being too close to the neighbors. He would have some place for storage also. Copeland asked if Tyson planned on the greenhouse being for personal use or commercial as the property would need to be rezoned to become commercial. Tyson said it would be personal now but might consider trying to become commercial later. The Mayor and Tom pointed out that the Town doesn't want to set a precedent by allowing Tyson the variance. Tyson stated that he didn't feel he was asking too much with the variance as others, even close neighbors, have built into the 25 ft. setback. The Council realized this but past mistakes or issues from the past shouldn't affect the future. Shim felt where the house is out 7 ft. already, could allow the greenhouse to match that but no closer. Tyson felt he could go ahead move the greenhouse back 25 ft. and go with that for a time and see how he does. If he is very successful and wants to go commercial, he could come back and address that later. Tyson asked if he could put a 6 ft. privacy fence along his property. According to Town Code, he can only put a 3 ft. high fence in near the road. G. Discuss Compensation for Electric and Water Meter Readers as the Number of Meters Increase. Dave had worked up a sheet on where this issue stands. He passed out copies of this. It included the current wages and pointed out that originally this rate was set in 2020 and was found to be over what the national amount was and what other city employees were making so it was decided not to raise the rate for several years. It could be time to look at a wage increase now though. Oak City meter readers are part time. There are 17 more power meters now than in 2020. Have added an average of three power meters per year since 2017. There have been about 47 more water meters added since 2017. About 7 meters per year. The Town usually follows the social security cost-of-living wage increase. Tom felt like it would take quite a while, maybe 5 minutes or so to read a meter so might could raise a little. At three percent, the electric meter reader would go up about 2 cents per meter and water meter readers would get about .3 cents per meter. If we do this raise, they will be making more per hour than the secretaries and the Town Maintenance who spend more time at work and have more intensive jobs. Tom pointed out that they use their own vehicles. Maybe they could use the Town's four-wheeler but Angie pointed out that they would not be covered on the Town's insurance. If the four-wheeler was not working, they could use that as an excuse or reason not to do the job. Can't make much of an adjustment or they will be paid much more than the other Town employees per hour. If do it now, could keep it at the rate for at least several years unless there is a significant jump in the number of meters. Traci Callister arrived at this time 8:45. Angie suggested giving them a stipend of some sort. Dave felt maybe $25 a month for wear and tear on vehicles and gas. The Mayor suggested looking at a small rate increase every year but Dave was worried about that as it would put their hourly wage equivalent pay up significantly more than the other Town employees. The Mayor wondered about doing a 3% raise a year. Where would that put it? Dave said that would be about $89.00 a year which is a pretty big raise. Dave quickly went through the wage increases, how often and how much, through the years. The Mayor pointed out that the Compensation Ordinance is reviewed annually in December so might could wait until then to do a small increase. Dave pointed out that if the Town goes to automated meter reading in the future, the Town would not need meter readers but the cost of the changeover would be a lot and probably at least what the readers are being paid. Probably just need to raise the rate that covers the meter readers. More consideration will be given this matter at the December Town Board Meeting. H. Update on the Town's Well-Tom Nielson. Talked to Rhodes today and found that they put in acid and scrubbed the Well. It looks a lot better. They asked if the Town wanted to put in a new pump and head on it but Tom didn't think so. It would cost about $16 to $18 thousand. Told him not to worry about that upgrade. They will come back and pump it using the Town's pump. Will be a week or two before Tom will know where the Well stands. Rhodes wondered if the PVC needed to be put in but it would be a little crowded to do that and he didn't think it would help much. Tom thought it might be good to get a back-up pump. I. Discuss 2023-2024 and 2024-2025 Budgets. Angie went through the two budgets with the Council. Needs Tom to give her an estimate for the Well costs so it can be included in the old budget. There were a few changes that were made and still need to be made to the old budget. Angie asked the Council to continue to look at the old budget and get with her if any changes are needed. Angie went through the 2025 budget quickly as far as what had been added or changed. She asked everyone to let her know if there are any more changes needed. J. Discuss Updates to the Title V: Public Works Section of the Town of Oak City Town Code. The Mayor stated that he had gone through the original Emergency Response Plan which is in the Town Code. There was an attachment that went with it. Will table further discussion of this item until next month. K. Public Comment. There was no public comment. L. Monthly Financial Report. The Financial Report was Read and Approved by Board Action. The Mayor will talk to the parties on the cut off notices. M. Departmental Reports. Dave Steele. There was a system outage on the 29th April on a Rocky Mountain Line, which lasted from 10:50 to 10:55 a.m. There was no apparent cause. Received approval from Rocky Mountain Power and the Public Service Commission to amend the 'Agreement for Electric Service by Municipality to Additional Customers Outside the Municipal Boundary' for Rob Kelsey's new house. Clarified an invoice from Dixie Power to upgrade the installation of the Jeff Teichert power service to 400 Amp. There will be additional charges for this upgrade over a standard connection fee. A new invoice was sent to Jeff. It was reported to Dave that the McLaws house at 100 W. 100 S. had a higher usage than expected. Dave misunderstood the problem as a bad meter and he replaced it. He advised the McLaws to check the water heater for faulty operation, as this a common cause for such high usage. It was also reported that the Joseph Young house at 245 N. 100 W. was not turning or reading properly. Dave was out of meters so he ordered and received a new batch from Dixie Power. Will install this soon. Kurt Dutson reported intermittent power fluctuations on his house at 180 E. 100 N. Two other homes are on the same transformer. Dixie Power investigated and determined the transformer and conductors should be upgraded. Will do this soon. A new service and meter were installed by Dixie Power at the new Rob Kelsey House at 590 South Bald Hill Road. A permanent service was installed by Dixie Power at the new Rand Prince house at 160 S. 170 W. Discontinued the temporary service. Shaun Finlinson (cul-de-sac on 200 N.) reported oil leaking from a pad-mount transformer on his property. Dixie Power investigated and informed Dave that this will eventually need to be replaced, but it is not possible to do due to the way the transformer is supplied from underground wires, which can't be extended or replaced for a new transformer cabinet. This and other transformers in the cul-de-sac must have a new primary cabling installed, which will be a costly and disruptive project to the street and other utilities. Dixie Power does not have the equipment to do this. On the March 2024 Utah Associated Municipal Power Systems (UAMPS) billing, Oak City had a net energy delivery of 293,785 KWH. Total cost/KWH was $0.06703 for a total bill of $19,693.53. Because purchase price was below the operating margin, no power cost adjustment was ordered for the April billing. On April 23, attended the Rocky Mountain Power Wildfire Mitigation Meeting. It was basically a customer information meeting to inform of new policies and procedures in place regarding Public Safety Power Shutoff (PSPS). Their plan is that they will try to look at times where dangerous weather conditions could cause fires and they will shut off, automatically, lines that could be in danger. On May 7th, attended a Wildfire Policy Customer Meeting (Zoom Meeting) with the same topic as the April 23rd meeting, but intended to coordinate with Utah Associated Municipal Power Systems (UAMPS) members and other utility entities. On May 14th and 15th, attended UAMPS monthly board meetings on line. Today, there was a UAMPS Collaborative Communication Group (zoom meeting). It was intended to be a discussion forum for Public Information Officers in UAMPS. Officers were introduced at this meeting but will focus on ways and means to inform customers about utility issues. Will meet monthly. Copeland Anderson. The Forest Service has asked if they can use the Town's flag pole on June 8th. The Mayor was okay with that. Had Angie type up notices for bidding for the installation of A/C upgrades to the Town Hall. That had not been submitted to the Chronicle yet. E-mailed Jess, from the Six County Association of Governments, to see if he has any ideas of grants that might be available to the Town. Haven't heard back from him. Jared Rawlinson. Jared was not in attendance and had no report. Tom Nielson. Put Princes' water meter in. On the other Prince meter, found it is down about 6 ft. and the meter is not working so will be putting on a meter tree extension. N. Miscellaneous. Shim Callister. Got a GRAMA request, about two weeks ago, from Terry Howell (up the Canyon) wondering why the Town ended up inspecting her road. She wants the Town to use McKay's road down to the Ragsdale road for the use of the Town fire truck and not use her road. The Mayor told her that would not be possible. The Mayor advertised the selling of meat left over from Oak City Days but a citizen, Yancy Taylor, said that it was illegal to sell the meat as it was not packaged for resale and reported it. The Mayor was told that he could sell the meat this year but not next year unless they come inspect the Town's freezers. Will have to look at what to do next year. Might be able to just accept donations for the meat. Went to a MCEDA meeting for Millard County today and found out about another meeting also. Found that there will be monies available for economic development but not any infrastructure. It is a revolving fund. There were some people at the meeting from the State and they had funding for some things. State funding and Fed funding might be available to cover entire costs of qualified projects. Dylan Finlinson brought by the plot map for Jon Finlinson's subdivision to the Mayor and the Mayor and Dave Spence, Planning and Zoning Commissioner, signed it off. Moving forward on this. Scott Fuller would like a water connection on his South lot. Asked how the Memorial Day Program is coming. Tom is working on this. The Mayor has tried to talk with Greg Greathouse, the Town's attorney, to work on the O J Finlinson development agreement. Greg called last night and the Mayor talked to him again today. It looks like the Town needs to get a committee together consisting of a Town Board Member, a Planning and Zoning Member, the Mayor, and O J and get together at a Town Board Meeting to go over what needs to be done. Tom felt that it would be better to have O J bring a Plan to show what he wants to do with the property before anything is discussed. If O J wants to go with .04 acre lots and the Town wants to go with 1 acre lots, it would be good to know that before any discussion is held. The Mayor is going to meetings in Richfield next week, basically a planning seminar. Hope to get some good information from this. O. Adjournment.
