Notice is hereby given that the Planning Commission of the City of St. George, Washington County, Utah, will hold a Planning Commission meeting in the City Council Chambers, 175 East 200 North, St George, Utah, on Tuesday, June 25, 2024, commencing at 5:00 p.m.

1. Consider approval of a request to change the zoning from A-20 (Agriculture, 20-acre minimum lot size) and OS (Open Space) to PD-C (Planned Development Commercial on approximately 12.88 acres. The project is known as Lin's Market River Road. Applicant - AWA Engineering, representative, Rick Magness. Case No. 2024-ZC-004 - PUBLIC HEARING.
BACKGROUND AND RECOMMENDATION: This property has been the subject of at least two requests for a change in General Plan designation. In 2019, a portion of the southern end of the property was changed from FP (Flood Plain) and MDR (Medium Residential Density) to COM (Commercial). In 2020, a larger piece of the property was included in the request for a COM designation which was eventually approved in 2022. In May of 2023, the subject application was notified to the neighbors and was moving toward a public hearing at the Planning Commission. The application was pulled from the agenda to review access concerns, little has changed, but one access point has been removed. Staff recommends approval of the application with consideration of the following comments: 1. The developer will be responsible for installing roadway improvements as necessary along River Road as determined by the city engineer; 2. Conceptual building elevations, colors, and materials have been provided for review and discussion; 3. Future site plan review applications and plans shall be submitted and approved by staff. A site plan application will need to be submitted prior to construction on the site; 4. Approvals for the pad sites will need to be reviewed in future Planned Development amendment applications; 5. A full photometric plan will be required to accompany the site plan; 6. With the submittal of the site plan application, a full landscape and irrigation plan will be required. A conceptual landscape plan has been submitted for initial review and attached; Elevations and a rendering of the buildings have been submitted and attached (Staff - Dan Boles).
2. Consider approval of a request for a preliminary plat to divide the property into five lots and one parcel in order to provide individual pad for the proposed development. Though this plat is named Ridley's, it is associated with the request for Lin's. Applicant - AWA Engineering, representative, Rick Magness. Case No. 2024-PP-013.
BACKGROUND AND RECOMMENDATION: In conjunction with this application for a preliminary plat, the Planning Commission heard a request to amend zoning map to a PD-C zone to allow a grocery store and development pads. The proposed plat shows there are five building pads (the main grocery store on one lot and four surrounding pads). A shared parking agreement will be necessary to be recorded against all lots in conjunction with this plat. Staff recommends approval of this preliminary plat with the following conditions: 1. It appears the existing sewer line is not within the show easement. An easement dedication with the plat will need to cover the existing sewer line to be installed with or during the construction of the project; 2. Extend the 72' storm drain through the site to the Ft. Pierce was and grant a 40' easement for the storm drain (Staff - Dan Boles).
3. Consider approval of a request to change the zoning from A-1 (Agricultural 1-acre minimum lot size) to RE-20 (Residential Estates 20,000 square feet minimum lot size) on approximately 7.46 acres. The project is known as Haguewood. Applicant - American Land Consulting LLC, representative, Adam Allen - Case No. 2024-ZC-006 - PUBLIC HEARING.
BACKGROUND AND RECOMMENDATIONS: The applicant is seeking to change the zone from A-1 (Agricultural 40,000 square foot minimum lot size) to RE-20 (Residential Estates 20,000 square feet minimum lot size) in order to subdivide the property. This property is not part of a recorded subdivision plat. A home was constructed on the property in 2001. Staff recommends approval of this zone change for Haguewood (Staff - Dan Boles).
4. Consider approval of a request to change the zoning from C-2 (Commercial), R-1-8 (Single Family Residential 8,000 minimum sq. ft. lots) and RE-37.5 (Residential Estates 37,5000 minimum sq. ft. lots) to PD-C (Planned Development Commercial) and OS (Open Space). The property is approximately 7.13 acres. The project will be known as Dean Terry Zone Change. Applicant - Rosenburg & Associates, representative, Jack de Ryk. Case No. 2024-ZC-005 - PUBLIC HEARING.
BACKGROUND AND RECOMMENDATIONS: The subject property is zoned R-1-8 (Single Family Residential, minimum lot size 8,000 sf), RE-37.5 (Residential Estates 37,500 sq. ft. minimum lot size), C-2 (Commercial) and OS (Open Space). This application is to change the zone to C-2 (Commercial and OS (Open Space) for development in the future with the Commercial designation. Staff recommends approval of this Zone Change with the following conditions: 1. The applicant will need to submit a fully designed site plan and comply with all the requirements of the C-2 (Commercial) zoning code at the time of development (Staff - Mike Hadley).
5. Consider approval of a request for a PD (Planned Development) Amendment to the Boulder Creek Crossing Planned Development Commercial (PD-C) zone. The applicant is proposing an Office Building. The project will be known as Sheffield Office Building. Applicant - MWR Design, representative, Clay Lister. Case No. 2024-PDA-008. - PUBLIC HEARING.
BACKGROUND AND RECOMMENDATIONS: This request is for a PDA (Planned Development Amendment) to construct a new professional office building at the existing Boulder Creek Crossing Ph. 2 lot 13 site. The site is approximately 0.41 acres total; the site is located at approximately 1450 South George Washington Blvd. The two-story building will provide four (4) lease spaces. Staff recommends approval of this planned development amendment with the following conditions: 1. A site plan meeting all regulations of the code and consistent with this plan is required prior to construction (Staff - Mike Hadley).
6. Consider approval of a request for an amendment to the Desert Color PD-C (Planned Development Commercial) to develop a 2,990 square foot credit union on 0.97 acres. The project will be known as America First Credit Union. Applicant - Rick Magness. Case No. 2024-PDA-007 - PUBLIC HEARING.
BACKGROUND AND RECOMMENDATIONS: This is a request for an amendment to the approved Desert Color PD-C (Planned Development Commercial). The applicant would like to add an America First Credit Union to a .97-acre parcel located at the northwest corner of Desert Color Parkway and Black Ridge Drive. The building will be 2,990 square feet with a maximum height of 25' and will include two covered drive-up isles with 4 total teller's stations. The Planning Commission recommends approval to the City Council with the following condition: 1. The street tree landscape requirement is met along Desert Color Parkway and Black Mountain Dr. (Staff - Mike Hadley).
7. Consider approval of a request for a one (1) lot preliminary plat known as America First Credit Union, located approximately at the northwest corner of Desert Color Pkwy and Black Mountain Dr. The property is .97 acres and is zoned PD-C (Planned Development Commercial). The project will be known as America's First Credit Union. Applicant - Bush & Gudgell, representative Ryan Lay. Case No. 2024-PP-014.
BACKGROUND AND RECOMMENDATIONS: This is a proposed credit union in a portion of a commercial area of the Desert Color Master Plan. The overall site is .97 acres and the proposed building on the site is 2,990 sq. ft. Staff recommends approval of this preliminary plat (Staff - Mike Hadley).
8. Consider approval of a request to amend a portion of the City Zoning Ordinance, Title 10, regarding the Planned Development - Mixed Use (PD-MU) zoning category, specifically section 10-8D as it relates to the heigh regulations of the zone. Applicant - City of St. George. Case No. 2024-ZRA-010 - PUBLIC HEARING.
BACKGROUND AND RECOMMENDATIONS: The zoning code (Title 10) was revised in its entirety in 2019. One round of general changes was made to the code within six months to make updates to the code that were either mistakes or just not workable. One change that was made in 2020 was an amendment to allow the City Council to approve structures that exceeded the height of certain zones if a series of findings were made and with a recommendation from the Planning Commission. Most zones that were given that consideration do not cap the height if the findings could be made. The PD-MU zone still has a cap on the height even with the findings. Staff recommends approval of the Zoning Regulation Amendments to section 10-8D-8 (B) (Staff- Dan Boles).
9. Consider approval of a request to amend Title 10-2, definitions; 10-7E, Residential Central city Zone; and 10-17A, Specific Standards; of the city code to add provisions for Live Work Units to be allowed in the RCC zone with specific standards. Applicant - Lynn Potter. Case No. 2024-ZRA-002 - PUBLIC HEARING.
BACKGROUND AND RECOMMENDATIONS: City staff and the applicant have worked closely together on this code amendment. The applicant would like to propose adding Live/Work Units as a permitted use in the RCC District. It is proposed that Live/Work Units be allowed as a permitted with standards use, with specific standards described in Section 10-17A of the City Code. It is also proposed that Live/Work Units only be allowed in the RCC (Residential Central City) District that also have the Connected Neighborhood or Connected Corridor Land Use Designation. Staff recommends approval of the amendment to Title 10-2, 10-7E, and 17A of the city code to add provisions for Live/Work Units to be allowed in the RCC Zone with specific standards (Staff - Carol Winner).
