TOWN OF STOCKTON 18 North Johnson Street PO Box 240 Stockton, Utah 84071 Phone: (435)882-3877 PLANNING AND ZONING AGENDA Tuesday January 2nd, 2024 Notice is given that the Stockton Planning Commission will hold a regular meeting promptly at 7:00 pm in the Town Council Chambers at the Stockton Town Hall 18 N. Johnson Street, Stockton, Utah. In compliance with the American Disabilities Act, any individual who may need special accommodations including auxiliary communicative and services during this meeting shall notify the Town Clerk a t (435) 882-3877 at least 24 hours prior to the meeting. The order of Agenda Items may be changed if deemed appropriate by the Planning Commission. Time limits, if any listed for Agenda items are approximate and may be accelerated or delayed. Select 2024 Chairperson of the Commission by the Commission Gary Nominate Antoinette Romano to be Chairperson for 2024, Claudia 2nd All in favor 7. Otters and Others - Tom Rasmussen, member of the board. Kristen is trying to satisfy the state and the city. Kristin is an animal lover and has taken care of animals since she was young. She has horses and different other animals that are on her property in Stockton. They wish to have exotic animals on her property. They want to make a nonprofit animal conservation reserve at her property. There are 6 or 7 board members. Tom Rasmussen, Donita Rasmussen, Ann Ricks, Jared Higley, Dr. Roundy. 'We want to help the public appreciate and know what these animals are all about.' Donita is the head of the corporation. Kristen is not a board member. Wish to not cause the town of Stockton any problems. Everything is in a trust. State told her to be a nonprofit. Currently has a sloth and a kangaroo, otters, fox, butterflies, donkeys, zonkey, cows. Some were born in captivity. The fox is not the one that bit someone. She was only approved for the 'once upon a time' business for her horses. Otters and Others business has not been approved. US dept. of agriculture has been to evaluate. Lives west of rawhide on A2 Agriculture. She owns 7 and 1/2 acres and is leasing some of BLM. It is not a high traffic business, but a high traffic road. Possible Petting zoo? More focused on education. Parking would be on her property. Would be scheduled out for her zoo. Trying to get ADA approval. Dallins issue is zoning or conditional use permit. Amy (assistant fire chief) has inspected it, was happy with the work she put in that. Make sure code is followed. It is not an animal 'rescue' .' Kristin does not make decisions.' Possible rezoning for her property. Attorney will give info to the non profit. Adverse effects? She may need more property? Neighbors may not be happy living next to a zoo?? Neglect?? Does the business belong there?? Limit visits?? Access and Parking/ fire code?? Parking shouldn't be a concern (Amy) Safety issues/ proper permitting. 8. Council reports 9. Pledge of Allegiance 3- Jan minute correction item #7. The last line reads 'P&Z makes recommendation to Council' Im sure the intent on say that was that the job of p&z is to make a recommendation to the council, on any issue, but how it reads is that we did make the recommendation. We did not make any recommendation for otters and others. So either omit the sentence entirely or clarify that once officially on the agenda as a voting item, the p&z will make whatever our recommendation is. Item was omitted Antoinette motion to approved minutes with the above correction. Claudia seconded. Jacob said yes and Mitch abstained because he was not present last month. 4-5 No public comments 6- no item number 7- otters and others Jared Higley -Reiterated that they want to be an educational facility. -That he thinks A2 works as the zone they need to be in so not requesting a rezone. Antoinette read what was permitted in the A2 zone. Board said that based on those items, it doesn't really meet requirements. - Discussion of types of animals and enclosures - Current Stockton Zones -Need for definitions of: livestock, wild, exotic (exotic pet), domestic, dangerous, etc - Animal units per acre of land. P&Z gets to decide. -Only the 7.5 acres acres are owned the other 3.5 leased . Leased land cannot be build upon, so would that change the number of animals allowed. -land currently in tooele county green belt status. (does one supersede the other?) -guy thinks non-profits are approved for A2, Antoinette explained just because you are a non profit does not guarantee you get to be approved. -Info from Logan and SLC since they have zoos there. Logan zoned Recreation. SLC unsure (asked council to look into). They had definitions of exotic etc which we could reference. -Double fencing or no climb fencing. - Asked guy to send Diane anything that they have researched so that we can see it too. - Fire department comments about prior inspections and when public come onto the property it is a game changer. - Insurance with people on the property. 8- Council reports -Antoinette asked about needing the training link reset. Talked about order and decorum and training and asked for board to make time investment to researching our codes etc. -Mitch thinks his term is up.
