Minutes of Oak City Town Public Hearing and Regular Meeting Held December 21, 2023 The meetings were held at the Oak City Town Hall beginning at 7:30 p.m. The following were in attendance: TOWN OFFICIALS Mayor Shim Callister Council Member Dave Steele Council Member Monica Niles Council Member Dallin Christensen Council Member Tom Nielson Town Clerk Karen K. Lovell Town Recorder Angie Dewsnup OTHERS Jared Rawlinson Jon Finlinson Copeland Anderson Kerilyn Lovell An invocation was given by Dallin. The purpose of the Public Hearing was to get public comment on Town of Oak City Ordinance 2023-02, Compensation of Statutory Officers and General Employees. The Mayor explained the Ordinance quickly to those present. Dave had created the Ordinance and passed out copies. The Mayor went over the changes that had been discussed last month and were now included in the proposed new Ordinance. There was no public comment. The Mayor adjourned this at 7:36 p.m. The Regular Town Board Meeting began at 7:37 p.m. The same parties were in attendance. The following agenda items were considered: A. Adopt Agenda. Since the Minutes of the December 6, 2023 Town Board Special Meeting were ready for adoption, it was decided to add the adoption of these Minutes to this agenda as agenda item C. Dallin moved, second Monica, to adopt the agenda as amended. Roll Call Vote: Mayor Callister-Aye. Dave-Aye. Dallin-Aye. Monica-Aye. B. Adopt Minutes of Town Board Regular Meeting held November 16, 2023. Monica moved, seconded by Dallin, to adopt the Minutes as written. Roll Call Vote: Mayor Callister-Aye. Dave-Aye. Dallin-Aye. Monica-Aye. C. Adopt Minutes of December 6, 2023 Special Town Board Meeting. Monica moved, seconded by Dave, to adopt the Minutes as written. Roll Call Vote -Mayor Callister-Aye. Dave-Aye. Dallin-Aye. Monica-Aye. D. Discuss and Possibly Adopt Town of Oak City Ordinance 2023-02, Compensation of Statutory Officers and General Employees. Dallin moved, seconded by Dave, to adopt the Ordinance. Roll Call Vote: Mayor Callister-Aye. Dave-Aye. Monica-Aye. Dallin-Aye. E. Discuss Subdividing Property at Approximately 250 S. 225 E. - Jon Finlinson. Jon attended the Planning and Zoning Meeting last night and they discussed this item. At their November meeting, they had brought up a couple of issues and Jon reported that he had worked out the issues. The first issue was that Caleb Nielson had concerns with the road going next or near to his property and Jon reported that the road would go South of Caleb's. The other issue was that they felt the road needed a turn around and Jon has now included this in the specs for the road. Therefore, the Planning and Zoning Commission had voted, excluding Dylan Finlinson who abstained, to recommend that the Town Council approve the Jon Finlinson Subdivision. Jon now wanted permission to start. The Mayor stated that this still needs to go before the Town's Attorney. The Council discussed utility placement and a few issues. Jon is willing to move the utilities if needed. Dave said the power line is in under a prescriptive easement now. Jon and the Council went over a map showing roads, power, and discussed what would be best to do. Dave said Jon could go with overhead or underground power. The cost would be a little more expensive for underground but not too much. Dave will get estimates on both. The Town will allow one pole length, so about 200 ft., either overhead or underground before Jon would have to start paying. Tom arrived at this time. The Mayor explained to Tom that he had told Jon he could go through Tom and Ben to put in the water. Mr. Fuller is planning to help with part of the cost of the road and utilities as he wants to build a home in the area. Jon said he was ok with the utility easement going on the South end. The Mayor said that most of the subdivisions he has looked at have had a utility easement all the way around. Jon was ok with a 14 ft. easement. The Mayor asked if anyone had concerns. No one did. Dave will look into the power. The Town would like the road put in according to Millard County road specs and Smiths should know what those specs are. The water engineer said to go around the trees that Dave and Darcie Allan own. The current water line is 4 inch all the way around but that needs to be upgraded to 8 inch sometime so could put in an 8 inch T from the 4 inch line. There will need to be one fire hydrant there. Would probably need a yellow hydrant to use to flush the line. Jon will get with Dave and Tom on the power and water. The Town Attorney will need to look at it when Jon is ready. F. Public Comment. There was no public comment. G. Monthly Financial Report. The Financial Report was Read and Approved by Board Action. Kendall said the fire department would help with the cost of the septic tank. The Mayor wondered if the tree trimming is done. Dave didn't think it is finished but they have been paid. Got four parties that received notices of shut off. H. Departmental Reports. Dave Steele. Attended the Utah Associated Municipal Power Systems (UAMPS) and the Intermountain Power Agency annual meetings. There are a few things going on at UAMPS that he is watching. The Town signed up on a Fremont Solar Storage Project Study and is involved in a gas generation project study. Another one of interest is an advanced automated power meter reading system. Dave will be attending meetings on these projects. On November 28th, Tyson Hathaway had some road base brought in but there was an accident and an old power line was hit. Dixie Power fixed this. Dave has been getting ready for the Cascade Spring line extension. They are looking at starting on Wednesday. There was a question on whether a party's power account could be suspended where she does not use the power at all and won't for a while. Dave felt should at least charge a minimum. Maybe need to set up a policy on ones that are not used for years. There are costs associated with having a meter if it is used or not. If a water meter is not going to be used, Tom felt maybe it should be pulled as if left, it might freeze and have to be replaced. Could just charge $15 a month and put a lock on the meter. This will be a discussion for a future meeting. Monica Niles. The Christmas Eve Program and Santa are both lined up. Dallin Christensen. Had a sidewalk company who contacted him about replacing the sidewalk by Ken Christensen. They recommended removing the tree. Dallin wasn't sure he wanted to do that. Tom Nielson. Got the water connection in for Mason Anderson on Anderson Lane. Got done putting in the two new water meters which will be metering the water coming into Town from the water tanks. Going to put some boxes around them. It will measure the chlorine there and meter the water. Shut the whole town off for two hours to do this but it didn't really affect anyone much. Had an online meeting with Dace Whatcot. He sells a program called iworQ Systems which would go along with our GPS mapping system that will show valves that need to be turned off and on in order to maintain them. This program would help keep track of the maintenance issues and pictures of when maintenance happened. Will try it for this year, if it works well, will continue. It seems like a user-friendly program. I. Miscellaneous. Mayor Callister. The Mayor thanked Dallin and Monica for their efforts through the years. The Planning and Zoning Commission were going to look at Nathan Henderson's request to consider adding an accessory dwelling unit attached to his shed. However, he was not able to attend the meeting and the Commission tabled the issue until he could attend a meeting. The Commission discussed Jake Nielson's request for a Conditional Use Permit to put in on his dad's property. The Planning and Zoning is still working on this. O J Finlinson attended the Planning and Zoning Meeting to look at the possibility of getting his property rezoned. Sam Nielson was also there and was concerned about Lover's Lane Road. Much discussion was held on this. Dave Steele, understood that the road would run between the power poles. The Mayor stated that the road situation there is a mess. The utilities are basically a prescribed easement which needs to be figured out before the Planning and Zoning Commission would ever consider a zone change for O J. There are a bunch of water easements from back in the 80s that need to be recorded so that our attorney is able to vouch for our water system if needed when we apply for funding. Discussed a little about if going with a new well or just try to go with the old well and do aquifer recharge. The Mayor thought the old well will probably still need to be brushed. To make sure it is in the best condition possible if we need to use it. Tom will look into what can be done with the old well and look into aquifer recharge. The application is getting finished up for the new Well. If we aren't successful with a new Well grant, will still hang on to the Ron Sumsion property for substation expansion. J. Adjournment.
