Roll Call Vote: Commission Chair Spence-Aye. Peggy-Aye. Dylan-Aye. Kendall-Aye. D. Discuss Subdividing Property at Approximately 250 S. 225 E.- Jon Finlinson. At the November Planning and Zoning Meeting, a couple of concerns had been brought up. One was that the new road location might be either adjacent to or interface with Caleb's property. Jon reported that the road will be going in on the far South edge of Jon's property if needed in the future to loop the line. The other issue was that the new road should have a turn- around included. Jon presented a map that showed where that turn around will be located. The County is still reviewing Jon's Plan. The road can be dedicated to the City after it is built. The frontage requirement is 100 ft on each lot. At this point, the Planning and Zoning Commission would make a recommendation, to the Town Council, on the Plan. Then the Council looks at that and makes a decision. If the Subdivision were approved, it would go before the Town Attorney. The Mayor mentioned that the Town would need an easement, about 14 ft., so a water line could be put in. The water line should be able to be worked out between Tom Nielson, Town Council Member over the Water Department, Ben Nielson, Oak City Town Water Operator, and Jon. The Mayor will check on the specs for the road. Dave asked for any public comment on the issue. There was none. Peggy moved, seconded by Kendall, to recommend the Oak City Town Council approve the Jon Finlinson Subdivision as presented by Jon. Roll Call Vote: Commission Chair Spence-Aye. Kendall-Aye. Peggy-Aye. Dylan -Abstained. E. Discuss Allowing a Conditional RV Use Within Town Limits During Times of High Construction Housing Needs in the Area. - Jake Nielson. Dave reminded the Commission Members that this had been brought up some months ago. Dave was going to put together a list of conditions for a conditional use on this which will include that utilities would need to be in the name of the owner and have its own water, power, and sewer hook ups. He wondered if the Conditional Use Permit should be allowed for a one-year period. The Mayor mentioned that the County does a six month Permit. Dave will get the list together and send it to the Mayor. F. Discuss Adding an Accessory Dwelling Unit to a Detached Shed at 100 N. 245 E. - Nathan Henderson. Nathan was not in attendance so the Commission decided not to discuss this until Nathan could be present. G. Discuss a Zoning Change from Agricultural to RR-1 at approx. 200 West Center. - O J Finlinson. O J recently purchased some property but found he can't build on the property due to it being in an agricultural 4 Acre lot zone and he only bought a 2.5 Acre piece. He is hoping to get a zone change so he can build on the piece. Dave stated that before the meeting, he had talked to O J and found that he wants to put in three lots if possible. At the November Meeting, Camron expressed concern with making lots too small which could affect the Town's ability to provide water. Dylan stated that he would like to see a Plan drawn up. Sam was concerned about the road there. It was put in 26 years ago and should not be changed now to accommodate a zone change. There is a utility right-of-way there that the Town owns also. There is no water line on the North side of the road which the City originally required. There was going to be a road put in but it never was so Lover's Lane is a private access road in Sam's opinion. O J's property is on the South end of Lover's Lane and D J Finlinson owns the property on the North end. O J is will to work out the road so it will work for everyone including putting in 20 extra ft. from his property to widen the road. Sam stated that doing the zone change would create three crooked roads instead of just one. If the roads had been done on the City grid, it would have been better. O J felt that Lover's Lane is not a private road but a City road. Sam felt the need to keep everything square and that a standard needed to be set and he felt that standard was set 26 years ago. Camron arrived at this time. Sam stated that West of this area, three other parties want to jog the road to fit their needs. If this is done now for O J, they will want to do this in the future. Kendall asked if he understood correctly that if the road was placed on the City Grid, it would split O J's property in half but, in the process, he should get a little more property on the other side of the road. Sam stated that there are under laps and over laps in the area that causes problems. Craig Nielson subdivided in this area also and this has messed up things also as far as roads. The Mayor agreed that this area is a giant mess not only for roads but water also. Dylan pointed out that there are zoning issues here and utility issues. Sam stated that there is not a recorded easement now as he understood the City was going to record it but they never did. However, it has been in 26 years so there should be a prescriptive easement. Sam put the utilities in after meetings with the City. The City would not allow the utilities down Lover's Lane. They made him go on the road. Sam would like to see this mess fixed as best as possible before resolving the O J Finlinson situation or anyone else wants to buy property. The road itself is a one lane road and very dangerous for passing traffic. The Mayor said the town's attorney said the Town might need to go through him to cover the current utility easement situation. Sam says he has a copy of the original easement agreement with the Town and that the Town should have one also. The Mayor stated that he has been looking for a copy of this and has not been able to find one. Sam would like to see all water and road easements in place before any rezoning is done. The Mayor said if the easement is not officially recorded, it becomes a prescriptive easement anyway and it is a little different situation. Camron felt that the seller of a piece of property would be responsible to know the specifics of his property before selling so these issues don't even come into play. Jake Nielson felt it should be the buyer of the property that would be responsible for this. Camron agreed that either the buyer or seller would be responsible. Camron felt the need to stick to what the City has done and put the road in where it should go no matter how it affects the property owner. The City does not have to accommodate property owners at the expense of the City's regulations. Kendall felt if the Town wanted to take care of all problems at once, it would put all the roads in as planned. As far as Lover's Lane, the lane could be closed on one end so at least it would become a one-way road and a little less dangerous. Jake Nielson stated that he understood the need to be consistent but there is a mess for property owners in some areas. H. Miscellaneous. There were no miscellaneous items. I. Adjournment. Commission Chair Spence adjourned the meeting at 8:46 p.m. Submitted by: (Rough Draft) -------------------------------- Karen K.
