Minutes of Oak City Town Board Special Meeting
Held December 06, 2023
The meeting was held at the Oak City Town Hall beginning at 7:00 p.m. In the Conference Room.
The following were in attendance:
TOWN OFFICIALS
Mayor Shim Callister Council Member Dave Steele
Council Member Monica Niles
Council Member Tom Nielson
Town Clerk Karen K. Lovell
OTHERS
Rand Prince
The following Agenda items were discussed:
A. Invocation. The invocation was given by Shim.
B. Adopt Agenda.
Tom moved, seconded by Dave, to adopt the Agenda as written. Roll Call Vote: Mayor Callister-Aye. Dave-Aye. Tom-Aye.
Monica Niles arrived at this time.
C. Discuss the Board of Adjustment Recommendation to Grant a
Variance Allowing a House to be Built into the 40 ft. Rear Yard at 170 West 160 South-Rand Prince/Chris Prince. Chris
was not in attendance after all. Rand presented his Plan for a house
located at the above address which will not fit into the 40 ft. rear yard setback requirement. There really isn't any way a home could be built on the property without a variance due to the size and shape of the property.
Tom stated that Tyson Hathaway's property doesn't fit the setback requirements either for his greenhouse he wants to put on the property. Is it fair to grant a variance to Rand and not to Tyson?
Monica wondered what it would hurt to go ahead and grant the variance. Who would be affected negatively? Tom did not want to set a precedent and he wanted to be consistent with everyone. Dave felt the most important thing was to make sure a septic tank would fit on the property. Monica just felt each property would have to be looked at individually. Dave appreciated that Rand came to the Council first to work out the issues before building. Tom wanted to look to the future. Dave pointed out the need to be flexible also.
The Mayor read part of the Town Code pertaining to variances. It stated that one of the reasons to grant a variance would be so the property owner would not be denied reasonable use of his property or denying the variance would create a hardship for the property owner. Dave also read part of the Code which stated that the granting of a variance should not cause deviation from the General Plan or go against public interest.
Tom voiced a concern as far as if the Prince variance was granted and someone wanted to put in a pig pen behind the property, it would be too close to the house.
Dave wondered if the variance was granted, how does the legal process go forward to record it properly? If approved, the Mayor will write up the variance rules and make sure it has been recorded properly.
Dave moved, seconded by Tom, to grant the Prince variance based on the Oak City Town Board of Adjustments recommendation to approve the 25 ft. rear yard setback on the property. Roll Call Vote: Mayor Callister-Aye. Dave-Aye. Tom-Aye. Monica-
Aye.
D. Public Comment. There was no public comment.
E. Adjournment.
The Mayor adjourned the meeting at 7:50 p.m.
Respectfully Submitted,
