MIDYALE CITY, UTAH RESOLUTION NO. 2023-R-45 A RESOLUTION ACCEPTING AND APPROVING THE RESULTS OF THE MUNICIPAL GENERAL ELECTION HELD NOVEMBER 21, 2023 AS SHOWN ON THE CANVASS REPORT WHEREAS, on November 21, 2023, the Midvale City Municipal General Election was held; and WHEREAS, pursuant to Utah Code Ann. 20A-4-301(2)(a), the City's mayor and municipal legislative body comprise the City's board of canvassers (the 'Board') for the Election; and WHEREAS, pursuant to Utah Code Ann 20A-4-301(2)(b), the Board is required to meet to canvass the returns of the Election at the usual place of meeting of the City's municipal legislative body no sooner than seven days and no later than 14 days after the Election; and WHEREAS, on December 6, 2023, the Board met in the meeting room of the City's city council (the 'Council') for the purpose of canvassing the returns of the Election; and WHEREAS, the Board has determined that the Election, and the voting therein, were conducted in compliance with Utah state law; NOW, THEREFORE, BE IT RESOLVED by the board of municipal canvassers of Midvale City as follows: Section 1. The Board hereby accepts and approves the conduct and results of the Election. Section 2. The following candidates, resolutions, and questions are declared and certified to have received the number of votes indicated: Council Member District 1 (4-Year Term) Candidate Votes Bonnie Billings 641 Dustin Snow 284 Ben Umeadi 132 Council Member District 2 (4-Year Term) Candidate Paul Glover Votes 658 Council Member District 3 (4-Year Term) Candidate Votes Heidi Robinson 445 Evan Feinberg 378 Bart Benson 248 Section 3. The following three candidates, having qualified by number of votes, are hereby declared elected as members of the Council for the following terms of office: Bonnie Billings Paul Glover Heidi Robinson Council Member - District 1 Council Member - District 2 Council Member - District 3 Four-year te1m Four-year tenn Four-year term Section 4. The City's city recorder (the 'Recorder'), as its election officer, shall furnish a certified copy of the Election Results Report to the office of the Lt. Governor of the state of Utah on or before the statutory deadline for such submissions. Section 5. Attached as an exhibit hereto is a report containing the information required by Utah Code Ann. 20A-4-304(2) (the 'Report'). Each member of the Board has reviewed the Report to ensure that it is con-ect, and by their affirmative vote below, authorizes and directs the City's Mayor and Recorder to sign, record, publish, and file the Repo11 as required by Utah Code Ann. 20A-4301(2)(c). Section 6. By their signature below, the Recorder, as the City's election officer, also certifies that the information contained in the Report is accurate. This Resolution shall take effect immediately upon passage. PASSED AND APPROVED by the Board of Municipal Canvassers of Midvale City, Utah this 6th day of December 2023. Marcus Stevenson, Mayor
