D. Discuss the Curtis Jones Variance Request to Place a Shed on his Property, Located at 100 North Lover's Lane, 15 ft. from his Fence Instead of 25 ft. as Per Current Oak City Town Code. The Board discussed this, where it was located and how a variance might change things. Ron, pointed out that a water line is going to have to be run down that road and a pump put in. Who will pay for this? If the Town pays for property to widen Lovers Lane, they will be setting a precedent for the future. Ron felt that the Town should condemn the footage needed to widen Lover's Lane. Tom felt that the developer ought to pay the costs of widening the road. Norman Olsen reminded the Board that the issue before the Board at this time isn't the widening of Lover's Lane. The item for discussion is allowing a 15 ft. setback instead of a 25 ft. setback. There were also concerns with allowing Curtis to change the way the house would face on the property. Norman pointed out that the Board would not be voting on the location of the house either, only the footage setback on the shed. He also pointed out that the shed would be located off of 100 North Street not Lover's Lane. Norman also stated that there are other concerns in this area such as the road going in front of Ciaran's on the dump road is narrower than Lover's
Lane. Cameron explained that there are differences in property lines depending on which direction you measure from on this street. Ron explained that there are underlaps and overlaps all through ere Town. Ciaran Lovell could put his shed 12 ft. closer than Curtis according to his fence line. Norman wondered if the Board needed more information as far as where survey pegs are located before making a decision on the setback variance. He wondered if Mr. Jones had been made aware of the setback requirements and that the road will be widened. Josh stated that Mr. Jones was aware of the situation.
Josh moved, seconded by Chelse', to recommend to the Oak City Town Council, that the setback for the shed remain at 25 ft. Roll Call Vote: Chairperson Ipson-Aye. Chelse'-Aye. Ron-Aye. Norman-Aye. Russ-Aye.
E. Miscellaneous. There were no miscellaneous items.
