Notice of Certification of Annexation Petition
Pursuant to UTAH CODE ANN. § 10-2-406, the city of Cottonwood Heights (the 'City') gives the following notice:
1. A petition (the 'Petition') proposing annexation of an area has been filed with the City.
2. On 16 November 2023 the City's city council (the 'Council') received notice from the City's recorder under UTAH CODE ANN. § 10-2-405(2)(c)(i) certifying that the Petition satisfies the requirements of state law.
3. The area proposed for annexation in the Petition consists of approximately 95 acres of realty located within or near the 'Tavaci' development abutting the City's Easterly boundary, situated to the East of Wasatch Blvd. and to the North of Big Cottonwood Canyon. The legal description and a map of the proposed annexation area are set forth in the Petition.
4. The complete Petition is available for inspection and copying at the office of the City's recorder, 2277 East Bengal Blvd., Cottonwood Heights, UT 84121.
5. The City may grant the Petition and annex the area described in the Petition unless a written protest to the annexation is filed with the Salt Lake County Boundary Commission, c/o Salt Lake County Recorder's Office, 2001 South State Street, #N1-600, Salt Lake City, UT 84109, and a copy of the protest is delivered to the City's recorder at 2277 East Bengal Blvd., Cottonwood Heights, UT 84047, on or before 16 December 2023.
6. The area proposed for annexation to the City will be automatically withdrawn from a special district providing fire protection, paramedic, and emergency services, or a special district providing law enforcement services, as the case may be, as provided in UTAH CODE ANN. §17B-1-502(2).
7. A protest to the annexation may be filed with the Salt Lake Boundary Commission by:
(a) The legislative body of the county in whose unincorporated area the area proposed for annexation is located;
(b) The governing board of a special district under UTAH CODE ANN. Title 17B, Limited Purpose Local Government Entities - Special Districts, or of a special service district under Title 17D, Chapter 1, Special Service District Act, whose boundary includes any part of the area proposed for annexation;
(c) The governing board of a school district whose boundary includes any part of the area proposed for annexation, if the boundary is proposed to be adjusted as a result of the annexation;
(d) The legislative body of a municipality whose boundaries are within 1/2 mile of the area proposed for annexation; and/or
(e) An owner of any rural real property located within the area proposed for annexation.
(f) Owners of private property if the protest contains the signatures of the owners of private real property that:
(i) is located in the unincorporated area within 1/2 mile of the area proposed for annexation;
(ii) covers at least 25% of the private land area located in the unincorporated area within 1/2 mile of the area proposed for annexation; and
(iii) is equal in value to at least 15% of all real property located in the unincorporated area within 1/2 mile of the area proposed for annexation.
(g) An owner of private real property located in any mining protection area located in the area proposed for annexation.
THIS NOTICE IS PROVIDED PURSUANT TO UTAH CODE ANN. 10-2-406(1) BY ORDER OF THE COTTONWOOD HEIGHTS CITY COUNCIL.
