The Utah Board of Oil, Gas and Mining meets Wednesday, September 27 at 9 a.m. at the Department of Natural Resources building at 1594 West North Temple in Salt Lake City. Opportunity for Public Comment Board members will hear the following Matters at 10 a.m.: 1. Docket No. 2023-023 Cause No. C0250005-NOVCH04182023-1 - In the matter of ALTON COAL DEVELOPMENT, LLC's Petition for Review Petition for Hearing of Notice of Violation CH04182023-1 regarding disturbing land outside the permit area of the Coal Hollow Mine, Kane County, Utah. (The Board will receive a report from the Hearing Examiner appointed in this matter. This matter was continued from the August 23, 2023, Board Hearing). 2. Docket No. 2023-032 Cause No. 139-172 - In the Matter of: Request for Agency Action of PetroSwiss Capital Partners, LLC for an order requiring an accounting and payment of royalties to PetroSwiss Capital Partners, LLC from Blue Diamond Oil Corporation for the Powell 2-13-A2 K (API No. 43-013-31120) and Ute 3-35Z2 K (API No. 43-013-31133) oil and gas wells, Duchesne County, Utah. (On June 21, 2023, this matter was set for investigation and negotiation to be completed by the Division within 60 days. This matter was continued from the August 23, 2023, Board Hearing. The Board will hear the Division's findings and recommendation for formal hearing at the September 27, 2023, Board hearing, and if recommended, proceed with the formal hearing). 3. Docket No. 2023-034 Cause No. 132-20 - In the Matter of the Request for Agency Action of OVINTIV USA INC. for an order pooling interests, including the compulsory pooling of the interests of certain non-consenting owners in the Abbott UT 13-30 3-4-36-35- 7H Well and Abbott UT 13-30 3-4-36-35-46H Well in the drilling unit established for the production of oil, gas and associated hydrocarbons from the Lower Green River-Wasatch Formations comprised of all of Sections 35 and 36, Township 3 South, Range 4 West, U.S.M., Duchesne County, Utah. (This matter was continued from the August 23, 2023, Board Hearing). 4. Docket No. 2023-036 Cause No. 138-04 - In the Matter of the Request for Agency Action of REWATER LLC, for an order waiving Utah Admin. Code Rule R649-9-4.6.1 as it relates to the permit application for Proposed RNI Pleasant Valley Evaporation Ponds #1-4 and Evaporation Basin #2, recycled water ponds to be constructed and operated in Section 26 and the NW1/4 of Section 25, Township 4 South, Range 3 West, U.S.M. in Duchesne County, Utah. (This matter was continued from the August 23, 2023, Board Hearing). 5. Docket No. 2023-038 Cause No. 132-21 - In the Matter of the Request for Agency Action of OVINTIV USA INC. for an order partially vacating the order entered in Cause No 139-121 and instead pooling interests, including the compulsory pooling of the interests of certain non-consenting owners in the Powell UT 1-12 4-3-6-5-1H Well, in the drilling unit established for the production of oil, gas and associated hydrocarbons from the Lower Green River-Wasatch Formations comprised of all of Sections 5 and 6, Township 4 South, Range 3 West, U.S.M., Duchesne County, Utah. (This matter was continued from the August 23, 2023, Board Hearing). 6. Docket No. 2023-039 Cause No. 130-24 - In the matter of the Amended Request for Agency Action of Ovintiv USA Inc. for an order modifying and extending the Board's orders entered in Cause Nos. 139-90 and 139-134 to: (1) Re-orient a drilling unit from stand-up (vertical) and instead establish lay-down (horizontals) drilling units for Sections 3, 4, 9 and 10, Township 3 South, Range 3 West, U.S.M., Duchesne County, Utah; (2) Reduce the heel/toe drilling unit boundary setbacks for such drilling units from 330 feet to 100 feet; and (3) Eliminate any Upper Wasatch Inter-Well Setbacks from the Perank 13-10-3-3-3WH Well. 7. Docket No. 2023-040 Cause No. 132-22 - In the Matter of the Request for Agency Action of XCL RESOURCES, LLC ON BEHALF OF XCL ASSETCO, LLC for an order pooling all interests including the compulsory pooling of the interests of certain non-consenting and unknown owners, within a 1,280-acre (or substantial equivalent) drilling unit established for the production of oil, gas and associated hydrocarbons from the Lower Green River-Wasatch (Colton) Formations, comprised of Sections 21 and 22, Township 2 South, Range 3 West, U.S.M., Duchesne County, Utah. (The Board will consider the recommended findings of fact and conclusions of law generated by the hearing examiner from the proceeding on September 20, 2023). 8. Docket No. 2023-041 Cause No. 132-23 - In the Matter of the Request for Agency Action of XCL RESOURCES, LLC ON BEHALF OF XCL ASSETCO, LLC for an order pooling all interests, including the compulsory pooling of the interests of certain non-consenting and unknown owners within a 2,560-acre (or substantial equivalent) drilling unit established for production of oil, gas and associated hydrocarbons from the Lower Green River-Wasatch (Colton) Formations, comprised of sections 15, 16, 21 and 22, Township 2 South, Range 3 West, U.S.M., Duchesne County, Utah. (Referral to Hearing Examiner requested). (The Board will consider the recommended findings of fact and conclusions of law generated by the hearing examiner from the proceeding on September 20, 2023).
